Seeking advice:
When it comes to renting a house, in order to sufficiently notify a renter about the dangers of lead paint, do you have to give them a physical pamphlet, or is it sufficient to simply email a link to a PDF?
I'm renting a house in Fort Wayne, IN that was built in 1975.

I have copies of the pamphlet left and I give them one. I would print it off and hand it to them if I were you and have them initial a statement somewhere that they received it. I also have a sheet of information that has to be initialed by the renter that they have seen the pamphlet. It was from the state of NJ. --73.178.xxx.xx |

Our local paint stores no longer have them. I print mine off of the EPA website. Yes, definitely have them initial and sign the appropriate EPA document also on the web.
I have begun putting my booklet in a gallon zip lock bag, asking the tenant to leave it on top of the fridge or in a cabinet drawer. (Yeah, I just said that so you all could have a good laugh!) Just kidding, I do it, but I'm not holding my breath.

You need to give them a copy of the pamphlet, they come also in different languages. Also they must sign a form that they received a copy.
One time i rented an apartment to an immigrant family. They just got documented and i had to rent to them if they qualified. Not an issue. I got proof that they lived in the States for over 10 years. When a child chewed on some imported lead painted toys and got sick, their attorney claimed I had not give them a warning booklet and/or they couldn't have understood something printed in English.
I had the form stating they received two copies of the pamphlet, one in English and the second in Spanish, they signed it acknowledging receipt of the booklet.
It was a surprise to their attorney, who took the case on a contingency basis, that I had proof of receipt of the pamphlet and photos of their kids playing with Chinese Imported Lead paint coated toys. --47.156.xx.xx |

I've always given paper copies, that I print out myself - find it online. However, I like the idea of an electronic option. VA allows electronic communication, so I may look into that.
Give it even when not required, like to adults the rooming house - just to CYA. I have it in plastic pouch, hung on the inside of one of the kitchen cabinet doors & tell them it's there if they want to read it. I don't think it's been touched : ) --68.10.xxx.x |

I once had a guy break a lease 2 weeks into the 1 year lease after reading the lead pamphlet. Older house, new paint job, no old chipping paint. Nothing done wrong on my end. He had a young kid and got scared and said he had to leave because the possibility of lead made him nervous.
Ok.
Then called and cried that he didn't get his deposit back.

I keep a pamphlet on top of the fridge.
The lease mentions the pamphlet is located there and has a spot where the teni need to initial . Next to where they initial is the web address of the pamphlet as well.
I also have the one page form which they must sign.
I believe that a sane judge would see that I was not skirting the subject. If I failed to hand them the pamphlet, then I did acknowledge it in the lease. If that isn't enough I at the very lease had the additional form present. I think the big fines go to the people who are ducking the process altogether.

On the 1945 house, I even had it "tested", there was some chipped paint on one side. Came back no lead/clear.

information pamphlet." "Provide" is not defined more than that.
In my non-legal opinion, I would argue that giving them the PDF is "providing" it to them, but maybe a judge would see otherwise.
That being said, if they sign a document stating that they "received" the pamphlet, then it seems like you should be covered no matter what you provided.
I just have them sign the HUD-provided standard one-page form:

It complies with things and has a line to initial that they "received the pamphlet." I feel that that covers things pretty well.

Are you saying that the law somewhere defines that the only method of "providing" the pamphlet is to hand it to them?
What if you mailed it to them? What if you left it on the counter of the rental?
Again, if you get the standard form signed that says that they "received" it (again, the law only says that you have to "provide" it and they have to "receive" it), then I think that would qualify -- regardless of how you "provided" it to them.
But you are stating that you need to HAND it to them -- so can you tell us where that is in the law? I could not find it.

Well, I was just trying to answer the original poster's question if he could give them a PDF/digital copy, for example. I might argue that that does indeed count as "providing the lessee with the pamphlet" by my reading of the law. Especially if they then sign the document stating that they "received" it.
I actually give them physical ones myself -- but the OP asked about something such as a digital copy. I think it counts by law.
