Some issues were found during the inspection period on the duplex I posted about a few weeks ago. My contract (stand MO Realtor's purchase agreement) provided for a 10 day inspection period which ended on 10/10.

On 10/9, my Realtor sent the mutual release to the seller's agent. My Realtor has since asked the seller's agent many times about getting the seller to sign the mutual release so that the title company will return my earnest money. He said the seller's agent doesn't even respond.

What is considered the norm here? How long should I wait? --174.234.xxx.xxx

Please ask your agent to contact the Broker of the seller and request that the document be signed. Part of being the broker, hence getting part of the commission off the sale, is enforcing the requirements.

If neither the agent nor the broker respond, then send a demand letter, requesting they cure the situation within 10 days. The release can be signed with DocuSign if the owner isn't local and able to sign. The agent should have a DocuSign account since the Board of Realtors recommends it and they get a discount.

If they still don't respond, you can file a complaint with the Real Estate Commission in the state. Look at pr.mo.gov/realestate-about-the-commission2.asp for more info --131.151.xx.xx

Certified mail telling them they have 5 days to release the money or your file a claim w the re commission. Dealing with this will cost them time they probably don't want to spend. Also, contact the title company daily. They may have access to the fool and may nudge them along. --174.234.xxx.xxx

If your agent isn't that responsive to your requests, act interested in purchasing another house with that agent, have them start writing an offer. But let agent know you need to use the earnest money used in previous contract. JUST DON'T Sign new offer. Drop interest in new house before offer submitted. Don't sign it.

Don, waiters are losers. I've finally admitted this after waiting on subs and contractors. It's been a game changer for me. I would absolutely not wait in this situation. Theres bo reason for them to be this difficult.

You could start by threatening to post your experience with that agent/broker with a review from your local Yelp, Zillow, and other online review sites within 48 hours if your earnest money is not returned.

One time I had a 5 unit, 8 unit and 16 unit apartment properties on the market with a standard due diligence period. My broker/agent didn't want to rock the boat and allowed the time period to expire. I had given them 10 days to inspect and review all requested documents. That's 10 days from receipt of the documents, actually now a 14 day period.

So I told my agent to change the wording that said, "taking back up offers" to "back on the market". Well that put the fear into the three buyers. Two of them then accepted and released the deposit to me and the deal went through escrow. The third property, the 16 unit, they buyer put a lien on the property so I couldn't sell it to anyone else, but he refused to sign the final acceptance.

So I asked my broker/agent to use their legal department and resolve the issue. Then all of a sudden their fantastic in-house legal wan't for the clients benefits, it was to protect their real estate firm. I had been given false information about their support team. So I pulled my listing and filed a civil action against the buyer, my agent, the selling agent and the real estate companies insurance.

The seller agreed to withdraw his lien and close escrow. I refused to allow him to buy my property at any price. Once a jerk, always one. I got the agent on misrepresentation on the firms support team, their legal department didn't review any of my contracts, they only did defense of the firm. So They made me an officer that I accepted, can't disclose. An then they changed their sales tactics in all future deals.

I was not afraid of exerting my right to withdraw my property from the market. At worst I'd have a lien on the property and have to have my attorney sue to remove it. --47.156.xx.xx
