I have done it several times for slow paying tenants. If they don't pay the full amount due (including any legal fees that have occurred) , I issue a receipt that these monies are being accepted for Use & Occupancy Only. This receipt is to preserve my right to proceed with the non payment eviction.
In states like MA where the eviction process can takes weeks & even months it's important to get things started. As Fred[CA] said you can always change your plans.
In MA a tenant on a term lease has the right by law to cure a 14 day non payment notice every month during the entire duration of the lease by paying all monies due before the 14 days expire. A MTM tenant only has the right to cure a 14 day notice once in a 12 month period.
Even though I could do it on the 2nd of the month my personal policy is that if I haven't received the entire rent by the 5th of the month, I issue a 14 day non payment notice to the tenant.
