A friend hired Lowes to side her house,Lowes hired a sub who didn't do all the work and Lowes is going to refund some money and take it out of the subs check.What form does she need signed by both Lowes and the sub to make sure the sub doesn't end up filing a mechanics lein? --72.231.xxx.xxx |

A lien waiver.
It’s basically a form stating that the sub has been paid in full and waived all rights to file a lien. Some states have standard forms. Based on a quick google search it appears that NY does not. Might be able to find a local attorney to provide one for a few bucks. Any construction attorney should have one already prepare they could give you for next to nothing. --166.137.xxx.xx |

I'm sure Lowes will help you. I wouldn't worry about it. If they put a mechanic's lien against you, just sue Lowes. You have proof you paid Lowes in full so you'd have a case to sue them and I'm sure they'd quickly take care of it.

Absolutley a LIEN WAIVER signed by Lowes and it must state Lowes paid the sub.
Liens are nasty and hard to remove, can halt the sale of your property.
Don't fall for the line "THe contractro does nto have the money to file". What happens in real life is the ATTY files (just a few minutes of his time) and blackmails the owner to pay his fee to get the lien filing removed before it becomes a lien.
An atty I wrangled with has a pattern of doing this. No skin off his nose if he loses but $1500 each if he wins.
Another LL I know is going thru this now with his contractor.
