State Specific Question About: VIRGINIA (VA)

I have had a tenant for 5 years. He told me he wanted to stay another 7 years in 2016 and that he wanted the lease to automatically renew. I changed the lease, last year it renewed with no problem. The date of the lease is 10.1. - the lease has a 30 day notice of non-renewal no later than Sept 1. I did not receive one. Tenant has paid on time. 10.1.18 at 5:37 pm tenant sends me a text message that he's moving to texas to babysit for his new grandson. I explained to him he had a lease and that he was going to owe for 11 months that his lease makes him responsible for future rent. I am going to secure the property immediately after he moves out. it is going to take some time to get the property right. How can I go about finding him and suing him once I get the property under control? --216.54.x.xxx

Why?

Why waste the time, especially if he has moved to another state?

So you had a 7 year tenant that was paid up when he left. Left without a problem other than giving you notification. What do you mean some time to get the property right and under control? Take the month to do whatever needs to be done, charge the deposit for the appropriate work and up grade as needed. Then get a new tenant.

I really doubt a judge will give you the full 11 months rent. AND does he really have that rent to give you?

Accept the fact that he's gone, take possession, roll up your sleeves, bring the place to a rentable condition and find a new tenant.

You have an obligation to mitigate your damages by getting it rented again as soon as possible, without lowering your standards or changing your regular procedures. But you can't just let it sit empty for 11 months. --50.82.xxx.xx
