Years ago I agreed to allow my tenants to have a 4 ft. deep backyard pool. Since they would not keep the water clean with chemicals, the pool became a breeding pool for mosquitoes. Never again. --68.63.xxx.xxx

I think the OP is asking how to legally protect herself, meaning she wants to keep the pool.

First, find out what your city/state rules say about a fence around the pool, a gate, a lock, etc. Then follow these rules.

Second, contact your insurance agent and discuss your liability coverage in details, make sure you positively know it all.

Check with your liability insurance provider. They may have requirements like a 4-6 ft high fence or enclosure around the pool or the yard. You want to have enough coverage so that if someone drowns, your life isn't ruined.

And yes, they will sue you. That not-quite-up-to-code gate you installed that works perfectly for a person with at least a room temperature IQ will be cited as "reckless endangerment" that you caused.

I'm with the others though. A pool is trouble waiting to happen, so I would get rid of it. Above grounds aren't that expensive. Tear it out and buy a new one later if you ever move back in. --173.20.xxx.xxx

Cheryl, You don't have enough money to BUY enough insurance to protect yourself and your business from being sued in the case of an injury of death! A pool is "an attractive nuisance" and as such it is a danger to neighborhood kids, the tenants, and the prop owner! What could happen? Kids could sneak in (at night? when the home is empty?) and drown. The parents in their anger and sorrow WILL sue you. All the tenant have to do is forget to lock the gate ONCE! Or, maybe one of the tenants who HAVE permission to use it could also be harmed or die. Who will pay for the medical bills and the funeral? And the lawyer? You/your insurance company! Then they will canx your prop insurance. (That is,IF you could find an insurance co to insure you in the first place.) Sure--let tenants have a pool--what could go wrong??

Cheryl, Just get rid of the pool. Don't endanger yourself and your family from being sued for everything you own incl the rental prop and your own residence,BECAUSE there is no way to protect against a pool-related death.
