An apparently wonderful couple in every way want to rent one of our apartments. The only problem is that they happened to reveal their 4 year old son "has a slightly elevated level of lead in his system." Any suggestions on how you might handle this sensitive issue in the notorious State of Massachusetts?

Interesting question, which could mean you are actually trapped in a bind!

On the one hand, you may not want to rent to them, but on the other hand you may have to. I would get a lawyers opinion on this issue.

I would let them each fill an application & rent to them if they passed my screening. However I might add that all of my units are lead compliant. If my units were not lead compliant, I would find a reason other than possible lead issues to reject them. --71.174.xx.xx

Lawyer might be the best choice. An alternative would be for them to give you a WRITTEN statement about the existing lead levels for EVERY person in the family and that they hold you harmless and not responsible for those pre-existing conditions. --66.226.xx.xxx

Fran, you have to tell these people that you don't know if your rental has lead because when you say you don't know what lead compliant means you could be putting the kid in jeopardy.

When was it built? Before 1978 it could have lead paint all over windowsills and trim and maybe even walls. Have you had the water checked for lead? Get it checked.

If you want to know if walls and trim have lead paint on them you need to find a guy to test it and I had a great guy come to all my units with a kind of xray gun and it measured where the lead paint was and how much lead was in it. Fortunately I didn't have much anywhere except on some garage steps. The worst place for it is on windows because when they are raised and lowers it makes lead dust. If you had a big renovation done and the contractor did not consider lead paint it could be in dust all over your house. So before you do anything else, explain to these people that your home has not been tested, but you have scheduled it and will let them know as soon as possible and good luck finding another place. I took the lead remediation course offered in NJ and as I said, had all my buildings checked. You have to get the rental checked for lead and the guy who does it will know people who can fix it. --73.178.xxx.xx

Fran i really understand your point... All the houses built before 1970 have lead, so you have to know the year your house was built, normally at the purchase and sale of the properties, if the house is older than 1970, they should provide a certificate stating if the house is LEAD SAFE, some people even knowing that their house had lead, they don't do anything... So if they don't, they will provide a letter stating that they are not aware about lead or not (even knowing that there is), so you have to get a lead inspector to do that (they always said you can do it yourself with a self test that you can get in Home Depot or Lowe's, but i prefer a proffesional, but this is also a two way sword...), also you can contact your city hall Board of Health Dept and find out if they have any records, or even online... --73.159.xxx.xxx

For a fee, a person with an XRF analyzer can conduct a non-disruptive test on the walls, ceilings, base boards, window frames and any questionable area. Then they can print out a report. The test will show the surface and deeper into the surface. Fee's run from $250 to $500 for a afternoon of tests. Then you can prove the child did not get the lead exposure from your property. As you likely know: If you have flaking paint it needs to be prepared and repainted following RRP lead safe practices. Never dry sand as dust is the problem. Carpet is a good place for lead dust to settle and stay. No carpet is best. Window installers, and probably carpet layers, and any remodel that creates dust is a potential issue on pre-1978 properties and must use RRP practices. If you test and know of lead you are compelled to disclose that information. If you don't have knowledge of lead, you must disclose that. In Ohio, they can decide based on what you disclose. You also must give them a HUD booklet. Several mentioned asking a lawyer; seems prudent if you don't know. Your local REIA might be a good resource for local law. If you are renting to someone with a 4 year old, you are required to get a lead certificate before they move in. If your house a lead certificate it means there are not any lead hazards and therefore there is nothing for them to sue you for. Proof that the kid had elevated lead BEFORE they moved in only works in your favor. Of course, it doesn't mean they won't try to sue you anyway. Our state does have incredibly strict lead laws, but they protect the LL as much as the tenant if they are properly followed. Even if your tenants don't have kids under 6 , it is in your best interest to get a lead certificate. If you rent to someone without kids ( grandma,aunt, babysitter) and a kid spends some time there and has a high lead test you will be on the hook. I have had several people apply to new builds because they wanted a lead free home due to lead problems in the past. The only one I did not take was the one who wouldn't have the deposit money until she got her " six figure settlement check" from her present LL. --174.199.xx.xxx
