State Specific Question About: GEORGIA (GA)

We have rental that is on top of former Camp Gordon Artillery Range,house is sinking with $40,000 est repair. We did not know this until after we owned the property for 17 years. Now, support beams were put in place by seller to support a small landfill used by remodel contractors and statue of limitations comes into play to get former owners/contractors to help. Based on fact that numerous spent casings have been found on property and a verbal from experts that over years the small explosions could cause land to shift and settle, I have asked the Army Corp of Eng for help, of course they said No. One lawyer said go on TV and another said they could not help. 2 different congressman have sent letters to Army Corp of Eng and received the same standard letter. We have paid out of pocket $15,000 in repairs not covered by insurance due to settling issues and need to sell this house but now forced to let buyers know about artillery range. As a landlord, you know this house represents Years of my time, money and sacrifice and ANY feedback would be appreciated! --75.58.xxx.xxx

Sorry to hear about that.

There are several possibilities but most would take a long time, cost a lot and not be any guarantee of getting any compensation for you.

Let's instead look at how to get what you can and focus your efforts on making new returns on other properties to move ahead instead of "beating a dead horse" so to speak.

Think about these things:

1. How much have you collected in rent while you owned the place?

2. Is the place able to be rented as is now? If so, for how much and how long?

3. Can needed repairs be postponed or done in stages?

4. All places eventually are done and must be replaced. Can you sell it as is now? Look at your total over the years and maybe take what you can get and move on.

What IF you moved the house to a more stable ground area of the land? or to a neighboring property then did the repairs and sold the house. Then sold the land with all disclosures. Again here you have added upon added cost. Cut your loses and sell it as is. --99.56.xx.xx

I think you will run into the same problems people have with Shrink Swell soil or Expansive soils.

No one really covers this. If you want protection then have to pay for soil test before you buy a property. Which is rare for anyone to actually do.

In certain areas a soil test is now required for any new homes. I my area builders were not even responsible for 5 year old homes that needed expensive repairs. Since they were built before the soil test were required.

In your case I can see the landfill being the problem. But this is just a guess.

I dont think you would ever be able to prove 100% it was caused by the army or they did anything wrong. And if you did and it went to court 40K could be much cheaper than what the case would cost.

Dont think it is worth it. But if you want to proceed find a good Environmental Lawyer.

You've owned for 17 years. I suspect by this time, you are on your own for a new settling problem.

Couple years ago, I almost bought a house had serious foundation issues and looked into DIY to push those cement sectional post(forgot the professional term, pier?) down close to bedrock.

It is doable (I have engineer background). It's just time, not so much about money.. (I figure the cement product shouldn't be that expensive.. )..
