Is it possible to terminate 12 month lease?

A tenant ok for a couple of years, then everything starts to mess up. Kid was taken away by grandparents, seems no job, many visitors, rent not paid.

We can start eviction for rent owned. I still want to cancel the lease if parents help to pay rent.

you can't do both. you start none pay action with court -- you can't take money and than continue on with court.

No, I do not do both. I am worried if the parents make up the rent payment, then we cannot do eviction for non payment.

Besides rent owned, they get roomate in and cat in. The unit smells bad.

OK got it. In our state the LL must accept ONE time in a 12 month period. With that said-- the whole thing needs to be paid-- all costs-- court file atty etc..

I hope that someone from Missouri can chime in about accepting or refusing money once the process starts, according to the State's eviction law. I think in California, a landlord can refuse to accept payment once the process has begun. Tenants go around the issue by depositing money into a landlord's bank account if listed on a lease or pay-or-quit notice which is a sign of acceptance. This cancels the process.

I doubt that the tenant's parents will step up and pay the rent if they're already shouldering the cost to raise a grandchild, their budget already being stretched?

Best of luck and please share what happens if the guy pays and if the guy still doesn't leave after serving the notice for the cat as myob noted. --107.3.xxx.xxx

I think judge will let tenants stay if they pay. but landlord can do eviction even they paid some of the rent.

i heard landlord "cancel lease without cause" clause because it is hard to prove and argue with tenant. I do not know that is for month to month lease or 12 month lease.

you can't cancel without cause. you can't cancel without notice to cure defect. Almost every state-- if you accept money-- when you go for the writ of possession- the follow thru-- it will state "AND LANDLORD HAS NOT ACCEPTED ANY (KEY WORDS ANY AND MONEY) when you apply for writ. I don' think CANCELLING the lease will do you any good. In fact you WANT the lease in place to prove they owe money.

This situation sounds like eviction. Start it NOW because it will only get worse.

No do not start accepting rent from the parents. All they have to do is say they are tired of paying and stop. Now you are sunk again.

I started eviction today by sending the paper to my attorney. I do not understand what changed to this tenant. He was ok and have small child with him. His mom was paying his rent and I do not aware any problem. Starting last month, his child was taken away by grandparent. Rent is problem, also visitors, roommate, and cat problem. Maybe no job. By far the easiest is to evict for non-payment.

I suspect that no judge will evict for an unauthorized cat. The unauthorized tenants, you must prove that they are living there. It's not as easy as it sounds like.

If a tenant is late and breaks multiple rules listed on the rental agreement, you don't have to accept the rent, and start the eviction process at once.

Then get an eviction lawyer to take over the case after your P or Q. --99.59.x.xxx
