Returned last month rent. Kept security deposit (full month's rent). They left friday 31st afternoon. The cleaners were in there an hr after they left. Carpet cleaners the next morning and meeting with the painters. Today got an excellent tenant who will move in 5 days after the 1st. Collect 3 x the rent. We got lucky but we also cut our loses ASAP. The amount of damage they did in one short month was horrifying. Hate to think what it would look like any longer. --108.20.xxx.xxx

Terrible landlording. Rewarding bad tenants puts THEM in charge and leaves you with a reputation for for being a soft, weak landlord. But that doesn't really matter. Jeff it is not terrible landlording, it is good business. Reputation, what reputation, this isn't high school. I mitigated damages as per my responsibility. regained possession of my property far sooner than the courts would allow with a lot less damage to my property. and re rented to a far better tenant. There's the easy way and there is the right way. Some folks just take the easy way, and that works for them. Others hold the tenant to the terms of their lease.

If you go the proper route, then the tenant has an eviction on their record for the next landlord to see clear as daylight.

So by taking the cheap route of handing out cash, you jack up the next landlord. And one day, the landlord that gets jacked up is you.

If a tenant does us wrong, we evict. Every time. And we have a reputation for being ones who will take to the mat, no matter how long it takes or what it costs. As a result, lease violations are very rare. --98.245.xx.xx

I dont want hold the tenant to the terms of the lease, I want him off my property before he burns the place down and maybe kills others on the process.

I am supposed to worry about the next landlord while this guy kicks my umbrella policy into effect? Tenant is getting high on a 2x4 section of a 3rd floor roof, burning holes in my carpet, punching holes in my walls and doors and leaving the back door to my building open for all his druggies friends coming and going. My 1st responsibility is to my property not waiting the next 8 weeks to get him out via the court, risking him burning down my building. Jeff you dont know what you are talking about. 1. You know that evictions can be erased off someone's credit check for $$.

2. You know what they cost and how long they take, in a state like MA.

3. You know how expensive fixing can get.

4. You know that bet[MA] only wants the property back, fix it quickly and re-rent it.

I'm not trying to defend bet, this is not a court here, but your arguments may work for you, and that's fine.

Jeff, I forget to mention this as well:

Screening is useful, but...

- Not conclusive, many events can be deleted, abd reports get washed.

- It's a view, or partial view on someone's PAST. Can you predict the future by the screening? Most tenants live paycheck to paycheck, with no savings, and only an inch away from default. So even solid looking tenants can become weak looking tenants overnight.

One car accident, one body injury, one visit to ER, one firing from the job - and they stop rent payments, become hostile or non-communicative and destructive.

If they do not follow the agreement to the letter, broom clean and no damage, then get them out and file against them anyway.

This bad tenant had excellent credit. 3 xs the rent at move in. A good Job that was 3 xs the rent. Stated he did not smoke on his application. Was enrolled in the local college as a senior. I knew his boss. What I did not know was he was a massive pot head. In case you are not familiar with MA laws. Its all legal here now. 6 plants per person, you can walk into store now and buy it, no need for medical reason. This is going to be a real problem for MA landlords. --108.20.xxx.xxx

I am glad some of you have never missed something in screening or had something go wrong with a tenant. As I have said the great thing about this forum is you find what can work for you because we hear about what works for others all over North America.

ELT fee compensates LL for tenant leaving. Happy clause lets a PITA tenant go for LL peace and ability to rent to someone better. Cash4keys is incentive for tenant to leave, giving possession back to LL quickly, easily and before things really go bad. M2M allows the LL to just give notice to get rid of a tenant, or raise the rent to make it worth their while. They all have their place in our business and everyone can choose to use them or not.

Everyone has to find what works for them in any given situation in their particular house, area and state. Given bet situation, I probably would have done the same thing. Way too much aggravation and time to go to court, especially when you just don't want to deal with them for the rest of the lease.

Everyone has to do what works for them. If you want to reward tenants for bad behavior, go for it.

There are plenty of stronger landlords who don't roll over and who have built our businesses to the point where we can afford to stand our ground and not give control to the tenants.

Lots of landlords allow grace periods for late rent, don't charge late fees, delay repairs, etc. That's their right!

Why don't you try one in low income/war zone and see how/if it is luck or righteousness or business sense?

JB,most of my units are class c so I cant be that picky,i am looking for the tenants who are better than average for the area but still wouldn't want most of them in class b or certaintly class a units.I also don't care if they smoke in my units because 75% have someronme in the household who does and if I turned down smokers I wouldn't fill units very fast.I rent a lot of units to people getting SSI and SSD checks and no there is not much ambition in that crowd but I get the rent so I don't care if they go to work or not everyday --72.231.xxx.xxx

The pot factor is not the scapegoat in this case UNLESS this tenant was doing a synthetic mj. NOW this will create an increased problem.

Check your screen process and there may be something missed.

I believe it was NE that mentioned this in a previous thread, but it would be a good solution here: Use cash 4 keys FOLLOWED by a following through with the eviction. That way the judgement will be on the deadbeat's record.

Simple solution that works for the present and future landlords.

Smart business- check.

protecting your assest- check

I agree that it's a bad idea.

Cash for keys is a good idea when you are selling a place and want the people out, or if you want them out for some other reason in which the tenant hasn't violated the lease. For any other reason you might as well turn in your landlord card.

As others have pointed out it pushes a problem tenant down the road and keeps an eviction off their record. The thing is, their enablers could deservedly wind up with a tenant who just was bought out by another LL. --73.95.xxx.xx
