State Specific Question About: ALASKA (AK)
In the state of Alaska - Is a landlord authorized to rent to a tenant that uses medical marijuana for chronic pain that has been diagnosed by a doctor? If the tenant provides documentation from a doctor stating that that patient has been diagnosed for the chronic pain issue. If the tenant/patient "does not" have a statement from the doctor recommending the medical marijuana - is that a game breaker? --69.178.xx.xx |

You should still be able to prohibit smoking/vaping. Your tenant could consume their medical MJ via edibles. --98.146.xxx.xxx |

If you only knew how many doctors' reports, letters and recommendations are fake...
A few years ago they busted a doctor in Southern Calif who was writing these letters and recommendations for $50 a pop. The DA said that he has written thousands of them, every year, for years. --99.59.x.xxx |

As a landlord there medical situation is not my concern and none of my business,as RathdrumGal said you can still prohibit smoking on the premises so don't get drawn into there drama, just determine if you want to rent to them based on the usual items --72.231.xxx.xxx |

I agree with gevans, Ken and RathdrumGal. This sounds like the tenant is pushing the boundaries. So no smoking and it's not like they'll really have to go find edibles. Just a pinch between the cheek and gum might take care of their pain. If not they can always go with a good sized chaw and do it just like you would tobacco. Either way it's not your problem it's their problem and you don't need to fix their problem. --71.213.xx.xxx |

I think you could still make a strong arguement for not permitting any medical marijuana. Although it may be legalized by the state, it is still illegal in the eyes of the federal government. Federal law trumps state law which is why the medical marijuana stores cannot get financing through banks and are all "cash" businesses. --76.220.xxx.xx |

Common sense would say that if smoke affects other tenants you should not have to take them. But common sense seems to go out the window when certain groups are in charge. --73.178.xxx.xx |

Program3, your question is strange. "Is a landlord authorized to rent to a tenant that uses medical marijuana...?"
I, as a landlord, am "authorized" to rent to drug addicts, registered sex offenders, and all sort of other low-lifes. There is no state or fedeal law prohibiting me from doing so.
I do NOT need authorization from the city, county, state or federal gov't in my tenant selection.
