I have a tenant alway argue and tell me "Here is america, I do not know who is guiding you, we america...." when we ask them to pay rent on time.

We started eviction on the 10th,They paid half on 14th. They think it is my fault. In Mo we can still continue eviction even they pay partial.

Their new excuse"The mortgage company give 15 day grace period"

I said "people have to have good credit and job to get mortgage. The mortage company does not do repair or pay tax and insurance. We are busy and Rent is due on the 1st and no grace period"

They said "HFA and VA mortgage are easy to get and they choose to forclosure their home because...."

They have been there over 4 years. I do not undersnatd why they alway come up excuses and thinking they are smart and they insult me every time.

First, if you are asking for the rent, you are already in trouble. It should be demanded.

I'm sorry, but if they have been there for four years and they are still playing this game, that's on you.

You need to state when the rent is due on the lease and immediately follow through with proper notice service and then you have to follow up with a legal remedy as soon as is allowable.

Arguing with tenants is a huge waste of time, and you will usually lose.

I thought you said these are "new" excuses. Nah, they're the same old excuses I stopped accepting about 10 years ago.

I don't argue with people. All calls go to voicemail and all unpaid rent goes to the special process server for court summons. Life is good!

CJ, to answer your question, your tenants come up with excuses for not paying the rent and insult you because you allow them to. To be brutally honest, this seems to be such a recurring theme for you in many different situations, one can only infer that you encourage this behavior.

Rather than argue with me that you don’t argue with people unnecessarily, it might be better for you to engage the services of a trained behavioral counselor. If you don’t know one, ask your primary care provider for a recommendation. --192.159.xxx.xxx

Does any landlord ask for rent payment if they do not pay on time?

Yes, The trick is to ignore whatever some tenants say. Start eviction on the 7th.

Rent due on the first - I email a statement 5 days before as quickbooks makes it easy to do. this serves as a reminder

No rent by 5 pm on the 1st then I text - rent due

Pay or quit notice posted on the 6th (NC requires 5 days) that tells them an eviction will be on their credit report, they will be responsible for court costs and lawyers, etc. Either they make the payment plus late fee or they give you the keys and leave the property.

Eviction starts on the 16th (I am not sure NC requires it by my lawyer said 10 days shows you gave reasonable amount of time) -turn it over to the attorney and let them handle it.

I don't call them, either they get the money to me or I follow the protocol and make them go away and find someone who is happy to be there.

YI am so glad that you started the eviction process on these people. Please do not allow them to drag you into their nutty mindset in which you will "feel sorry" for them. Yes, I understand how you feel, and I just am so glad that you're learning to fight back.

As I mentioned, my friend who manages apartments in Berkeley speaks passable English with a thick accent. He has had to fight and learn for the past decades to get where he is now. I'm sure that you're more experienced and stronger now than you were when you started being a landlord.

I would like to know if they end up paying or end up moving out. It's a good time to rerent the place before Winter comes. --107.142.xxx.xx

The language of the lease is the one that counts in court when the tenant wants to change it to their liking, In the future you might consider going to all bank transfers where it can be printed rather than having to listen to this bulloney in person or on the phone.
