Please give me direction ..... what can I do legally ? On Monday Special Civil Part Officer came and evicted tenants. I haven’t had this type of eviction in over ten years . Tenant for five months rent on the first ... then in July no rent so on third called left message ... got a text I’ll have the rent on Friday and it is now $875 ... next text ... thank you and good luck !

The rent is $1800 as in the written lease as it has been for the past 5 months ... not about to start texting back & fourth so letters - filed- the no show court - won by default -!filed for possession - awarded and eviction was Mknday.

Not one word from them since - I had apt emptied and all their possessions in locked garage.

Tonight 10 pm neighbor calls to say they saw tenant pull up to mailbox ( end of driveway) get out and get mail & quickly drive away.

Eviction officer told me if they come back on property without prior arrangements ( like to get their stuff). to call police .

Car was in street and they walked onto property- They are no longer tenants ... what can I do ?

Totally agree ... and first thought ... most logical move BUT NJ law says I have to send certified mail to them ( when no “new” address send to last know which is my apt. ) to instruct them if after 33 days their property considered abandoned ... in N.J. we have to store “safe keeping” We sent letter sent yesterday ... now normal ppl have mail stop or forward - I don’t want to be responsible for their belongings cause they didn’t get notice cause no mailbox ? As stupid as it sounds - I am always amazed when I sit in Landlord Tenant court as to what goes on there ... --69.127.xx.xxx

After my sheriff lock out I went to the post office to find out how to handle it. Boxes for each unit in the common hallway. I had to hold possessions for 7 days. They told me to wait the seven days and if tenant hadn’t contacted me, just gather all the ms from the box and bring it to the post office and they would put a hold on delivery. After the 7 days, I caught the postman and he took the mail back with him to put a hold on it. --76.89.xx.xxx

My practical reason is probably more personal ... by the time we got a court date we a two months out of rent ... just spent my time to have their belongings video documented before being bagged up and moved to be stored for safe keeping - the apartment had brand new carpet and two totally renovated full baths fresh paint - and now after six months it looks like a war zone !

I don’t want to give them the time of day let alone letting them continue to use the mailing address

They no showed for court - address used was rental ? I think as Still Learning suggested go to post office for direction - My husband is leaning toward taking the whole post with box on it right out of the ground until we need it again ! --69.127.xx.xxx

The mailbox is the property of the post office, that's Federal. You can not remove it! You can tell you postal carrier that the tenant has moved and to forward the mail or sent it back to the sender. Then put a note on the mailbox to your old tenant, mail is going to be returned to sender, you need to put in a forwarding address within the next 48 hours. --47.156.xx.xx

Mail sent by you certified will come to you when not taken by the tenant, I remove mailboxes all the time and have sat on the porch steps taking a rest when the carrier comes by - I tell them the tenant moved, Oh ok we'll keep it at the station, never heard anything about the box being guv property, the location however is calculated into the route and if you convert a single to double the postal inspector comes to verify this. --76.188.xxx.xx

Put something in your lease to the effect “mail box location will be selected by landlord”.

Don’t know if mail boxes belong to the government but I have yet to get a receipt from government to pay for any mailboxes I have purchased, constructed or put up.

Just me but I think the mail box belongs to me but the space or contents INSIDE the box belongs to the govment.

If you believe you must keep a mailbox there, replace it with a locking one. Mail goes in but you need a key to unlock it to get the mail out.

Another vote for removal in this situation. Technically they are not supposed to "get mail at an address they no longer live at". Send your letter certified and it will bounce to you. Clearly they want something in the mail. If they were smart-they have a new address for the important stuff already lined up-the PO can forward-not your problem. --73.230.xx.xx

I was having this happen. I took the bad tenant's name off the mailbox and told the mailcarrier that they had left. She no longer delivered the mail there. The grandmother, who is another tenant and was the cosigner, came back looking also for their mail. Grandma was looking for their tax refund check which she felt was owed to her. So essentially she was going to steal mail which is a Federal offense. She stopped when I told her I had spoken to the mail carrier and nothing was going there. Then I found a piece of mail for the tenant anyway and wrote on the front, moved to xxxx xxxx, the Grandma's address. The Grandma has actually written their last name on my expensive mailbox at her house, in paint. So when I got this piece of mail it was a credit card bill type envelope. The credit card company now knows how they can find the tenant. Ha ha. --73.178.xxx.xx

I was updating front doors on two units side by side and I had removed the mailbox temporarily and didn't get around to replacing it right away. After a week in the occupied unit the post office stop delivering their mail and the Tenant contacted me to say that the post office would not deliver the mail without a mailbox. So I say go ahead and take the mailbox out and they won't deliver the mail --99.203.xx.xxx

Either remove the box or tell the PO tenant isn't there. PO will put a vacant tag on the box and not deliver there anymore. After a couple days, they'll get the hint of no mail. --98.175.xxx.xxx
