State Specific Question About: SOUTH CAROLINA (SC)

Ive been living with my boyfriend since February 2018 we moved to south carolina june 2018 to mew residence where he failed to put me on the lease this time the place we moved from we both were on lease but for some reason he failed to wait for me to sign this time. He has decided to change locks and lie to police again and say i only spent one night there . i do recieve mail there the internet bill is in my name and police department will not help me . I have no where to go all my stuff is inside home even my purse and he has blocked me from calling and dont even have my clothes or shoes to go to work in. I have no idea who or how to get help. The landord is willing to help me any way even though im not on lease the landord knows ive been there since june and have even handed him rent checks ive given my boyfriend or ex money for utilities and pay for groceries. Take care of his son so he can work full time . But lies to cops and for some reason seem to believe him when I have actual proof I've been living there --172.58.xxx.xxx

You are outa luck temporarily, this is a civil matter, landlord should not be able to help except post a notice of violation the locks are off the company master system and if not changed back in (whatever the court rules are) then she/he can drill and install another set of locks costing the tenant however much is agreed on in the lease - mine is going from 25 to 40 per lock. --76.188.xxx.xx

The land lord may want to help, but he/she has laws and rules to follow. If the tenant refuses entry, the land lord can't just go in and/or break down the door and allow someone to remove stuff. The current tenant on the lease has lawful possession, and he could accuse the LL of theft. So that means the LL would have to take his tenant to court to force the issue and possibly evict him. I'm not sure if he'll be willing to do that to help you. No offense, but if it were me I would not get involved.

Police don't get involved in issues like this because they are considered "civil issues". Civil as in "not criminal." No one has broken any laws; he's simply being a jerk which isn't illegal. He didn't steal your stuff. You took your stuff in there and left it. He's the legal resident; you may be considered a resident by default, if your state laws define any resident as a legal tenant regardless of whether or not you signed the lease. But you have to prove it in court before the police will get involved. They aren't agents for the Dr. Phil show. Their job is to keep the peace, and if you or the LL disturb the peace without the legal right to do so...then it will be the two of you who get in trouble, not the lawful resident. Bad news, sure. But true news.

So what would I do? Probably see if I can find a pro-bono attorney to send your (hopefully) ex-boyfriend a nasty gram. Threaten to drag him into court and charge him with something unless he turns over your stuff. I have no idea what you could threaten to charge him with, but hopefully your attorney is a master of bluffing.

Ultimately, this is a domestic issue that you two will probably have to work it out on your own mostly. It could be an expensive life lesson.

Nina,

CAreful of what "you were told" unless that person is an attorney who specializes in land lord/tenant real estate law. There are a lot of arm chair attorneys out there who heard something from someone and repeat it as the gospel truth without bothering to verify it.

Regardless...even if you ARE in fact a legal tenant, you have to PROVE it. The police are not going to help you, and your land lord cannot assume it is correct. Only a judge can make that determination...which means...court.

Don't get me wrong: hopelessly ignorant land lords will sometimes do silly stuff like enter a unit over a legal tenant's (your hopefully ex-boyfriend/jerk) protest, but he's taking a risk as are you. For example...

Let's say you and your land lord go over there when he's at work, enter the unit, and find all the cash removed from your purse, so you decide "hey, it's only fair that I take this $50 that is sitting on the coffee table."

In your mind, that's fair. In the land lord's mind, that's fair. In your (hopefully) ex-boyfriends mind, you're screwing with him. He will call the cops, claim you stole $50 from him. You will retaliate that he stole from you first. The situation will quickly disintegrate into a Jerry Springer Show-style verbal fight with "he said/she said" and the cops won't know who is telling the truth, because they are not interested in your messed up domestic affairs. Whoever throws the first punch will probably go to jail for assault, and the other person may get charged for trespassing, etc.

See, this is a MESS, precisely because of the slip-shod way it's been handled so far. Get some professional advice from a professional source. Your best friends don't count, nor does your dear old MeeMaw or Aunt Tilly. Get an attorney: follow his/her advice.

I hope this works well for you....I truly do. But messes take time, patience, and often cost a lot to make right. Go slowly, go carefully....no matter how much you want to punch him or key his car...don't do it.

Is there a YWCA or a woman's shelter in the town? Did the police have any suggestions for where you could stay safely? Sometimes a woman's shelter will know how to handle things like this and have free lawyers. Do you have anyone back home that you can call and ask for money for a bus ticket? I would do that and even forget about my belongings and just go home. I have found that the police seem to think women are not smart for some reason. --73.178.xxx.xx

You must have met or spoken to some of your neighbors? Go to the police with the neighbors phone number that can confirm you were living on the property. Get a police escort to remove your items from the rental. File a police report. You were illegally locked out. Not even given a 30 day notice to vacate. He has stolen your possessions and valuables. If the value of your stuff is worth over a few hundred dollars, then this should be a crime. When you go to the police, bring a friend as a witness. The police have got to help. This is a civil issue as has been stated. This is why police are not getting involved. Unfortunately, you are looking at an attorney getting involved as well. Be very careful of what others tell you. As Sid mentioned, armchair lawyers can only think they know the law.

Unfortunately sometimes, the wheels of justice turn very slow. You will prevail, but not today. You may not also prevail as high as you wanted. Get what you can and get out is my best advice. I had a tenant who kicked out his roommate. The roommate got a free legal aid attorney to help him file a wrongful eviction lawsuit against my tenant. the Court ordered my tenant to let the guy back in the house, to give him the new key and to pay him about $500.
