Is there a chemical test for tobacco smoke? I had a LL friend that tried to use the paper towel smudge thing suggest by several ll's here. The judge said how do I know it wasn't from candles or cooking (which was the tenants claim) Handyman caught him smoking several times,..

I don't know about a test. But, are you saying that damage/dirt left behind by a tenant is evaluated by your courts as to what caused the damage - and treated differently based on that? WHAT??! Dirt is dirt - no matter if it's from smoke, cooking, or whatever. They still need to return the property clean.
Am I missing something? Were you trying to evict based on the specific charge of smoking in a non-smoking unit? I would think cleanliness is also a requirement in the rental agreement? Or trying to get judgement for damages after the tenant left? --68.10.xxx.x |
