I had the unusual experience today of being the applicant instead of the LL. A friend is looking for an apartment. A LL in town he contacted followed the exact protocol I use. She pre screened him and then invited him to an invite only open house. Right out of my play book. I went for him ( LL was aware of this ahead of time). I arrived at the apartment and this is where our seemingly identical showing styles lost any resemblance at all. It became very clear why the unit was not advertised with pictures. My eyes are still burning . But....fear not. She had another ( unadvertised) unit available. This unadvertised unit was not disclosed to all who were present at the open house. As shady , and likely illegal, as this is I don't know if it's brilliant or stupid. I definately felt the " bait and switch", but she may not have had bad intent. The unadvertised unit was a higher rent so she may have only showed it to those who income qualified. I still would have not done it like that. I did leave feeling good because my units are 30 years ahead of that competition.

There are many landlords out there who have gone rogue since day 1. Many of them have success at it. A lot don't follow the rules and quite frankly don't care. I know of several here locally. No screening a tenant at all. Gut feelings, renting to friend, etc. NEVER ANY ISSUES!! Plus they get paid

You don't know if she is going to advertise it tomorrow or not. Did she actually say that "I don't show this to everyone but you are "special" ? She may or may not have been intending to discriminate, but she did (perhaps unknowingly) set herself up to be questioned, and have to defend herself. If the landlord and you just happen to have the same skin tone, for example - someone with a different skin tone could (justly) question her offer to you to view a nicer place.

When Jeffrey spoke here recently, he clarified the practice that Ken mentioned in a way that makes a lot of sense - especially after his experience of being accused of discrimination.

Use advertising targeted to those you want AND do general advertising to cover yourself from being accused of discrimination. --68.10.xxx.x

Great post!

Good to get out and see the competition.

And yes, 30 years ahead!

From your description of the offering I would be bery concerned about discrimination.

A few months ago the Indianapolis Fair Housing Commission sent out testers and found 76% of LL/PMs tested blatantly discriminated by offering upgrades or first month free etc to certain people but not others based on skin. YIKES!!! And sooo dumb. All money is green (or digital!)

I'm pro discrimination. If I sense you are remotely lazy, I suddenly need to go fix a plumbing pipe or something.

Others will say that they can always find a way to disqualify you based on their criteria - however it is put, it is the same result.
