Read in the local paper that there was an incident on a street where I have a Sec. 8 resident. Since there are maybe 9 houses on that street, I figured it was my house. Texted resident (who is moving at the end of this month!!). She texted back that she "hosted" a party for her daughter. Fight with some guys started in the garage. One dude pulls out a gun and starts waving it around. She got him outside where he then shoots 5 times in the air above the heads of many party goers.Paper said ther were 100-200 people there. Police thankfully took over and she went to police line up and identified shooter. What would my liability be if.........somebody got shot....damage occurred to other houses? Should I raise the amount of my liability insurance? --24.233.xxx.xx

Geez, someone keeps calling the police when shots are fired at one of my rental. It is just the tenants target shooting. They have my permission and are within all legal requirements to do that.

Of course any one can sue anyone else for any reason. Whether they win that is another story. Just make sure you do have an umbrella policy that covers your rentals and personal property in a high enough amount. Once you pay for the basic umbrella, adding a couple million over is not that expensive.

I would not think you as the building owner have any liability for any one else carrying a weapon and discharging it recklessly. You can't be there with a metal detector checking everyone that comes to a tenant's party. HOWEVER, this does sound like a tenant you might want to not have in your rental. I would put up with a tenant that has a party for her daughter with 100 - 200 people. --108.44.xx.xxx

1. What does you lease say about this? Mine has several sections about criminal activity, including this: "LESSEE, any member of the LESSEE's household, or a guest or other person under LESSEE's control shall not engage in acts of violence, including, but not limited to the unlawful discharge of firearms, on or near the subject leasehold premises."

But do we know if the person shooting the gun was a "guest"? My understanding is that with such a large party, many of the people attending might be complete strangers!

2. Your liability: If someone was injured, you would be sued. However, was there anything you did to encourage the shooting? Was there anything you failed to do, that a reasonable landlord would have done, to prevent the shooting? Without knowing anything about how you conduct your business, it appears frivolous to sue the owner/ landlord for the criminal activity of someone who the landlord may well have never known anything about.

Sounds like just another party in the hood to me. Usually it seems such parties end on the front page with some innocent kid getting shot by some ahole.

Unless you are furthering a street gang in some manner liability shouldn't pass to you. It's the same as if a tenant gets shot by someone in a domestic fight. It isn't your job to provide personal security - unless you ignore obvious indicators and fail to take action to stop things. I.e. evicting a known problem tenant that escalates.

I had a tenant's adult son get shot in the arm/shoulder in front of my apartment building. The mother wanted to sue me for having an unsafe environment. I explained that her son belonged to a rival gang and he was wearing the wrong gang color. The mom said, "can you prove my son belongs to a gang"? I said of course. Just have him take off his shirt and you'll see gang tattoos all over his body, or review his arrest report. I then told the mom I can make this a much safer building if I evict her and her two sons.

You can get sued for anything. I saw a lawsuit where the Sec. 8's adult son (by the way mom who was getting Sec. 8 was actually living in another state at the time) was having a little gathering. Son put together a little fire pit in the backyard. Friends thought it would be a good idea to get fire started with gasoline. Fire went up to the can from the line of gasoline and splashed all over party-goer causing serious burns. Yes, landlord got sued. Who's got the big pockets? The bullets from those shots fired into the air have to land (hit) somewhere. Stupid and kills innocents.

My Sec8 office automatically drops anyone if the police file a report. Now the LL is stuck with a resident who could have been good but now cannot pay due to stupid behavior by someone else. Been there.

100-200 at a party? Yes, time for her to go.

But she probably cannot move without her Sec8.

We had an arson fire in my town. Eight dead. Since it was S8, it was a federal offense. PHA has its own police force. Much smaller PHA in next county checks newspaper every day for crime reports in their units. With them, she could lose her voucher.

Make sure you sue her for damages from the party. PHA will make her pay or she will lose her voucher. Have to have a court judgment for that to happen.
