hello dear landlords:
I have a fairly new (within past 7 months) tenant, single mother of 3, live in boyfriend not disclaimed on lease.
tenant is constantly late with rent (past 5 months, always a story, always seems to have drama). Does eventually pay but too much back and forth. Her lease is up next month (she is on a 30 day).
Any ideas on how to best handle? Send letter and Terminate lease with 30 day notice, raise rent, etc. --68.15.xx.xxx |

I would just send a letter advising you are not renewing their rental agreement. In California if the tenant has been there over one year it requires a 60 days notice. Or you could jack the rent up a lot to cover your aggravation . --75.22.xx.xx |

Hi tonia, anyone who calls me "dear" gets at least a 3 sentence answer. ;-)
We get what we allow. If you allow her to pay late, she will. If you don't, she won't.
I send a remind text the day after rent is due. It's very simple: "Rent?" If they respond, it's usually something like "I forgot" or "Oh gee, it's the 2nd of the month again?"
Whatever. I need the money in the bank no later than 6 days after it's due. There's a late fee due every day it's late: $25 the first day, $5 each additional day. Any money received is applied to the late fee first and the rent last.
If they don't respond or don't pay by the 7th, I evict them.
Pretty straight-forward. 90% of my tenants pay on time. The few who don't pay with the full late fee. It's all about training them right from the start and not allowing their excuses and drama to become your problems.

paying on time is tooooo overrated. Lets face it tenants pay based on the day they get paid-- if they can get 4 or 5 more days they feel like they're ahead. So if rent is due on 1st and the first is Tuesday-- they get paid Friday-- they can float the rent for wednesday, thursday, friday (their pay day) pay Saturday you get Monday-- so you collect 5 days late at 8 to 10 bucks a day times -- maybe 10 property's doing that? 50.00 X 10 tenants= $500.00.
Then there's the chase downs-- -- AKA court people you've filed on. Usually 10 days/ 100.00 plus court and fees-- admin fees $60.00 drop off notice is 25.00-- pick up payment another 25.00. so there's 100+60+25+25 = 210.00 times 2 properties= 420.00 now add the 8 who are late the (the rent float)

I would decide this based on her income and how hard it is to get someone who at least is not wrecking your unit. If boyfriend is paying then he has to come up with it and may not have it on the first depending on what he does for a living. So your choice is 1. do I keep working to get this rent which eventually comes in. or 2. do I kick her out and lose a months rent and get someone who might do the same thing or worse. --73.178.xxx.xx |

It sounds like you are fed up, and the late fees are not worth the hassle. So, give the notice required by your agreement & your state that you are not renewing. Be prepared for push-back. Don't listen. Include in your non-renewal notice that all communication must be in writing, and stick to it. Be prepared to file for eviction when they don't pay or go. --68.10.xxx.x |

I can't believe I'm saying this--but I agree with MYOB (we are usually on the opposite side of things). I never understood all the high demand for on-time rents. As long they pay the late fees, I am willing to collect it! I had one tenant in my only condo who was almost always late--maybe 6mo out of the year--but he always paid all the fees. He said I was the best LL he ever had because I was not always dunning him for the rent, and I was happy to collect $25-$80 extra multiple times/year. He had an out-of-town job demonstrating/selling medical machinery and often got bonuses for the sales. Then he would pay up all charges, and it would start up all over again.
When I decided to sell the condo to my daughter he grumbled but left on time and the place was clean! --108.87.xx.xxx |

I don't tolerate chronic late payers. It's not about the money for me but the hassle and extra work involved. In several cases I gave them the option to pay twice monthly with an added fee to each payment. Every one of them jumped at this arrangement all collected via auto-draft. It costs them more (so more rent for me) bit not as much as their late fees would and it helps them manage their money better or so it seems. They've all been told the rent will be reduced if they ever want to switch back to paying in full on the first of the month. Never have I had one switch back. You don’t have a LATE PAYER you have a lax MANAGER who is not enforcing the rules. Someone is ALLOWING this to happen as Sid said. (Gee who could THAT be??)
Time to step up the managing (notices with teeth and follow thru) AND talk to him about his pay schedule.
Golden nugget: telling him to pay on time or else will go absolutely nowhere other than raise your anxiety level. Flappin your lips in the wind.
Action: We send a 3 day notice by text on the first day it’s late and they pay. They really pay. If they don’t we file. Then they realize we mean it and pay. VERY FEW are ever evicted.
Also, TAKE the rent from their account, not WAIT and HOPE they decide to finally pay.
Another: there is nothing magical about the first. Perhaps he’s late because he’s waiting for a paycheck. 70% of our new leases choose PayDayPlanRent either weekly or bi-weekly to coordinate with their paycheck. WE love it because we get paid without hassles and make big bucks in service fees.
Let us know what develops.

I love folks who pay late. Rent automatically goes up $50 at 5:01 PM on the first, and then it's $25 per day starting on the second - the same day they are served with a 30-day notice. I have made over $3000 in late fees in the past 2 years or so. No complaints!

I faintly remember being a young east coast motorcycle racer all paid by late fees, I lived in a 12 unit and managed 24 next door, that was in the 90's before we added meters to each water feed, no complex leases - eviction was quicker, before we quit to buy a house my now ex-wife paid cash for a full length mink coat.

Admin fees =$60.00, drop off notice 25.00 and pickup. Most of the time we are happy they paid for the court fees and late fees, but I might have to consider that.

New tenants 2 people sharing 1200 rent. Good references, job and old landlord. Now moved in paid security and rent. 2nd month late paid about 15th of month with late fee, 3rd month partial payments 3 of them final payment 23 of month with late fee. 4th month partial payments still waiting on rent. Actin for next rent due --
For September 5 day notice will be served and executed if rent is not on time.
For landlords who see income with late fees that's nice but my mortgage is due on the first. IL doesn't allow you to charge administration fees etc. The longer they pay late eventually they STOP paying and that can be a financial hardship. I had a tenant stop payi g right before winter it took me 8 month to evict.
