there are 3 sec 8 or housing tenants and they have been here for the past year since May/June of 2017, they are not to have any others with them in the unit but I'm becoming aware that there may be "boyfriends" living there. A few ways to solve this, does anybody smoke or vape there - as of today instant out with a photo to the HUD staff, notices been floating well over a year about this and your manager should have a plan in force for at least 3 months. Next is the same idea - ask names and can you show me a bank statement or utility bill from where you live? Complain to tenant and photo them to HUD - advise your tenant they will lose housing with an eviction and this is clearly violating the rules. NE: It isn't clear to me either even after reading the original document. I get the impression that it DOES apply to privately owned units taking something such as Section-8. (It does not apply to privately-owned units not taking government assistance, of course.)
Also, just so people have the right information, Vee is incorrect about part of it. It does NOT apply to vaping. This was specifically clarified by HUD.
In any case, I think this route is a poor way to try to deal with Patricia's original question.
Patricia: To answer your question... My question to you would be: What do YOU want? Do you care about the extra person in there? Or are you just worried about the Section-8 "rules" being broken? In other words, if you don't really care if a boyfriend sleeps over, then I wouldn't worry about it much.
On the other hand, if you don't want them there, then just realize that there is likely no good solution other than losing them as a tenant. People that let their boyfriends live with them are going to continue to do that no matter what you or Sec-8 tells them. Therefore, if you threaten to evict -- or you tell Sec-8 and they threaten to remove them from the program -- just know that it is just a matter of time before they are no longer your tenant and you'll need to find another one.
For some, that might be the best answer. For others, they would rather not deal with the vacancy. So, it really comes down to what you want. But just know that the solution of "the boyfriend moves out and they just continue to live there properly by themselves" is very likely NOT a reasonable option, unfortunately.

HUD funded, so that is the apartments, HUD multi or single around the county, and if a HUD payment comes to you then you too. I see the AZ allows electronic cigs, in my area it includes vaping but -reasonable accommodations- can be applied for by phoning the HUD office staff.
The article WMH has enlightened us with mistakenly describes HUD as a private housing provider and that the maintenance staff is not allowed to perform routine inspections - I have to assume the article author has not been exposed to landlording yet. --76.188.xxx.xx |

John MI, that is the answer, what do I want, I really don't care as long as the rent is paid and the place is kept clean which it is, I didn't want it to be used against me since One of the tenants is becoming a "lawyer" and is causing friction with the others in some way or another and brought one to court for harassment and tenant cannot go on the front porch by court order , so since I do not live there they let me know what is going on. Patti, for future reference it's never a good idea to use your full name on these types of forums.
Does your rental agreement specify who is to occupy the unit?
Does your S8 contract list the occupants?
Do you have any proof that someone other than those named on the rental agreement & contract are actually staying there? Mail being delivered, car in driveway, etc.
If you don't want them there send the tenant a notice to cure & cc the housing authority.

Take pictures of the extra cars there at night and in the morning with a time/ date stamp camera. Check the mailbox for extra names and take a picture of that. I have used both successfully as proof of unauthorized occupants with housing program. --71.10.xxx.xxx |
