Ask the clerk at the courthouse. Here in Michigan they have a form the server fills out and submits to the court when they know tenants are avoiding them. This form allows things to progress. --66.188.xx.xxx |

I would guess that your state has some kind of process to permit service by publication.

If your attorney is using a "service processor" tell him to stop. Service processors are just companies that hire ding-dongs and for a flat fee that they will go out to the same location and try service. If your attorney gets a state marshal (that's what they are called in CT so I am guessing it is similar in Massachusetts), it will cost more, but they will go the extra mile to hunt the person down. In addition, people seem to be more responsive to state marshal's when they call. Find out where the person works too so that you have some different areas to track. --32.211.xxx.xxx |

A paid process server should KNOW how to serve people.
Does your state require a professional server and person to person service?
In my state we can tape it to their door. I also send it by text.

Our blue states requires lots of stuff. In Ct, if they haven't paid rent after 10 days (you have to wait 10 days), you have to a provide a "notice to quit" telling them that they have an additional 3 days to move and that has to be served by a marshal. (total time for that is a whole week) Best to serve in-hand but they can be delivered abode. Then, if they don't comply, you have to start the actual eviction process that is served by a marshal. And guess what, if you screwed up anything in the "notice to quit" - didn't serve everyone living there, didn't put the correct wording, etc. - you get to start over from scratch. I WISH I could tape a notice to the door. LOL In my law office, we use "process servers" for easy service of documents, but I use state marshals when I really want someone hunted down and served. --32.211.xxx.xxx |
