Resident did not pay as agreed. Court hearing last week. Tenant wants till early August to move out. No answer was given and now an appeal has been mentioned but not filed. --74.141.xx.xx

These individuals have had a large number of repair request. Some of the repairs have been their fault. They do not follow the lease agreement at all. They had claimed stress and surgery coming up --74.141.xx.xx

I have never understood what defense there is to non-payment of rent. Just baffles my mind that you can not pay your rent, but yet expect to stay there. I've had a judge side with the tenant one time over this as well. He gave her an extra 2 weeks to move because she was boo hooing and crying so loud, you could hear her at the other end of the building. I asked for immediate possession because she would have 2 more weeks to tear the place up and not pay rent. He denied. Guess what, in 2 weeks it was torn up (I was inside 3 days before court date) and I never collected that 2 weeks (or the past 2 months) worth of rent.

Do not speak with the Tenant. Speak with the Clerk of the Court and ask about the Order of Possession.

Once you hire the court just let them do what they do, If the tenant can pay arrears into court escrow they might get an appeal but unpaid rent is unpaid rent is unpaid rent, the lease terminates and the tenancy follows in 7 days. --76.188.xxx.xx

did you file for possession? you should have done that the day of the hearing and then on day 11 the constable does his job. newish change for the landlord ... VERY few loop holes that I know of in this process. --72.70.xxx.x

Would recommend contacting a landlords association to advise. Google to find near rental. Keep the rental unit to minimum standards where no loose plaster or drywall, no loose or missing tiles, no unpainted plaster or drywall. Colour does not have match on anything or tiles have to match as long as there is no missing tiles. All electrical, plumbing, heating, hot water has to work. Roof must not leak, windows, door locks must including bathroom door. They may contact building then not allow you to make repairs so if they no allow in a work order can not be written. Keep records of repairs made along with bills for materials. Repairs can be made right up to day the sheriff arrives. In the meantime be prepared to show at the hearing then say to the tenants as little as possible. If there are no serious building code or fire code violations above minimum standards then the rental unit is in a state of reasonable condition which may not be cosmetic or look great. Offer at the hearing for them to pay into court. If they have nothing then ask for the judgement along with writ of possession. In future find out about the process about thorough credit checks on all adult applicants to avoid problem tenants in the future. Advise can be given from a landlords association. Often they never return completely filled out rental applications end of story. For problem tenants getting evicted is a way of life that is a never ending story where after a few evictions they can live rent free for a entire year. What would happen if the tenants did not receive a pay cheque. The tenants would be down at the labour department the next day for sure where they would not accept excuses along with broken promises. --72.142.xxx.xx

I guess I'm confused. what do you care when they want to leave? If you filed for possession last week time is up in 11 days (meaning the beginning of next week probably). Constable reposts and in 11 more days the unit is yours again. --72.70.xxx.x

This evection was started without an attorney. Consulted an attorney on this issue sense. The attorney said if there is an appeal it will probably push the date back considerably as it’s a completely different court. What happens in most cases they extend the free rent period. Once they are out then can take them to small claims court for damages, arrears. Also file with the credit bureaus that there was a eviction for arrears of rent which is going to prevent them from playing the free rent game. Many employers often avoid people with credit problems as it is a matter of trust. If have a judgement then look at wage garnishee process for arrears. --207.164.xxx.xxx

what I'm saying is appeal period is all but over. They aren't going to appeal in order to stay until the beginning of August because to do so will cost them $$$ ... not positive but I believe they need to pay all the arrearages to the Prothonotary and then continue to pay the Prothonotary monthly. You then file some type praecipe monthly asking for the money and the Prothy pays it to you.

I forget who it was but someone o here went through this recently ....hopefully he'll see this and respond.

I'd love to know a Pennsylvania statistic for how many possession orders are appealed ... my guess would be less (much less) than 1% when they figure out how much it costs them and that they must continue to pay rent.

Monday I was told is last day to appeal.

The thing is the attorney had said they may be able to get hardship from the court which would not mean the same amount of $ that they need to come up with if a judge believes their hardship. --107.77.xxx.x
