OPM of OR is correct go online and search the Florida Statues for Landlord/Tenant and it should be clear on what you should do. The power being off may be a factor that adds to your remedy of the situation. I have read the statues but do not remember the factor if abandonment of the unit.

Texas has no definition of abandonment (which we found out the hard way), so we had to write one in our lease agreement. I've had to use it once in the five years since needing it the first time... but it made things beautiful and straightforward and non-stressful.

Check what Florida says, and then add it to your lease agreement so everyone knows the rules that y'all play by if someone falls off the planet.

Play this situation out correctly, depending on your laws... but add some words to your lease to make things easier with the next time in mind. --166.137.xxx.xx

The word abandon gets used a lot when people travel out of state to assist a family member,take a vacation, go to the hospital unexpectedly - and sometimes is linked to unpaid rent meaning time for eviction filed and then a court order to recover the unit, one thing can change this that is key to property control, the keys. When you have been given keys back you now have control of the place and can clean, repair and refinish once photos have been taken showing the damage the manager can bill to the tenant, this often begs the question why did the unit get so much damage and the tenant was never asked or demanded to [ay for the damages while they were a tenant? I am also Robin[FL]!

Anyway, this is what my attorney told me when I had to have tenants evicted a few years ago - if you let the eviction go forth to the end where the sheriff executed the writ of possession (should be 4-6 weeks or so from now), you do not need to store their belongings. Once the writ has been executed by the sheriff, you can change the locks & set their stuff on the curb. Neither you nor the sheriff are liable for what happens to their stuff at that point. --108.188.xxx.xxx

Consider donating what is usable to charities as someone would be use instead taking everything to the dump. Often found usable items could be donated then broken, dirty items to the dump. Credit checks on all adult applicants will minimize problem tenants from starting another eviction. --72.142.xxx.xx
