My neighbor on one side of our rental had the property line surveyed with the intent on putting up a fence. Their gate is attached to my chain link fence and it appears now some of her gate is on my property. I tried to have a very nice chat with her and explained that she can do whatever she wants except touch my property. She states she is not taking the gate down that is on my property and would like to put up a fence on my property.

OK... Well if I take my chain link fence down, her gate may still be there but not attached to anything and if she tries to install any fencing it will be on my property. My plan is to have my lawyer send them a letter to remove gate. But thinking I can just remove my fence and the gate will be hanging there unposted on one side, leaving her property open to her dogs getting out or anyone one walking in. --74.104.xxx.xxx

Imo its not a good idea (though I agree with the concept. If dogs or someone got hurt you couldbe considered a contributing factor. I wouls just send my own take it down lettet by x date letter and see what happens.

I had a similar issue with a swinging chain link gate. They had a 8' gate but their area only had six feet of room. So they cut down one of my post and changed the layout, instead of using a smaller gate. After asking the owner next door to correct his mistakes, I installed two metal posts on both sides of his gate so it can't be opened either way. I has a hydraulic post driver and sunk a 3 inch diameter post 15 feet into the ground and filled it with concrete.

When my manger saw the neighbor trying to cut down the post, he called the police. With a survey report in hand the neighbor just let things stand and used their gate on the side of the property. --47.156.xx.xx

Why does she want a fence if you already have a chain link fence installed? Is it because she does not like the look of chain link?

I used to not like chain link -- until I had to replace a wooden fence 2 times in 30 years while my neighbors orginal chain link held up beautifully.

While, in general principle I try to have good relations with neighbors (even if I secretly cannot stand them), I would not let her put up a wooden fence on my property. You will end up paying for a replacement 10 years from now when the wooden fence fails, or the next owner of the house will be mad at you. Make sure her wooden fence is clearly on her property.

Offer to let her pay to have the privacy slats woven into your exisitng fence. Or she could zip tie the white vinyl lattice panels on "her" side of the fence.

It's possible that it has been there long enough to cause her to have a right of way. I know how you feel, especially if she has been a bad neighbor. But the gate can only help you and you need the fence to keep her dogs from hurting your tenants and your lawn so I would negotiate a right of way with her. Does the gate really bother you that much? How long has it been there prior to you realizing that it swings into your property? If they’re good neighbors otherwise and don’t cause you problems I wouldn’t make a big deal over it. Silly thing to get into a dispute over. --98.216.xxx.xxx

I agree with Johnny B, 100%. What's the big deal? Be a nice neighbor, if it's not hurting anything. It sounds like it is close to property line and been there a while.

2. We are selling and dont need any property line disputes to muck up the sale

3. Local building dept advises to remove other people's property off our property.

No Big deal, we are removing our fence which is attached to their gate and moving anything we dont own off our property.

Oh the fence wars I have had. I will never ever put up any fence at a rental property ever again. It will cause problems for you during the impending sale if it is an encroachment of your property. I know ( from paying lawyers) during a similar situation that you may remove anything you want from your property. You do not have to give notice. I did because I did not want the neighbor's dogs to get out. I didn't like the neighbor's, but I love dogs. She may qualify for adverse possession if it has been there 15 years and it is her fence. Let her pay a lawyer big dollars to figure that out. --71.10.xxx.xxx
