Tenant notified me last month of bedbugs they found in their 2nd/3rd floor unit. They apparently first tried to correct with chemicals they purchased and did lots of cleaning. They said they threw away a lot of bedbugs I guess they killed. This is a 2-unit dwelling. First floor unit has been vacant 3 months and is extremely clean, etc. Tenant first said that the bedbugs must have come from the 1st floor unit and from the recent dryer replacement. The dryer actually came from my home. I said I would get an exterminator and put on my credit card and they would have to pay me off in monthly installments--since they have no credit cards and couldn't pay directly. The exterminator inspected the 1st floor unit and the laundry first. This laundry is shared and 1-2 other tenants use it from the other building on the property. The exterminator found no evidence in the laundry area and no evidence in the first floor apartment. He found evidence in the tenant's unit who said they found bedbugs. The exterminator said it was not a huge issue but could tell that the bugs had been there a while. I said someone brought them into your unit. They said they understood when I told them that they had to pay. So I paid for pre-treatment of the vacant unit and of the laundry as a precautionary measure. I told the tenant they will be expected to pay for the 3 treatments of their unit. Now they tell me they won't pay and that I should pay, that my request that they pay will uphold in no court of law. I said We can go to court. They said We have lived here a few years, and you (landlord) are responsible for the building, so you should pay, and we will not stop inviting people in the unit. I said, "No one is telling you not to invite people in. As an example, you invite people into your unit and they break the toilet, you will be expected to pay. Someone brought the bedbugs into your unit and you will be expected to pay." Lease reads: Infestation caused by Tenant: If Tenant's rental unit is the only rental unit infested in a multi-unit structure, Tenant shall be solely responsible for all extermination cost. They have to pay, bedbugs simply are any and everywhere, the tenant has to do the majority of housekeeping like everything thru the dryer then into plastic tubs - this is universal, and in 3 weeks they could have them again from a friends house, any used furniture or clothing brought inside, so easy to happen. --76.188.xxx.xx

Has this building had BB in it before? If not...

I'm not expert on PA law, but I believe the tenant is responsible for this cost, since they are the only ones there, they or their guests brought them in.

You are responsible that their unit and all other units get treated (safe and habitable) but you aren't required to pay for their damage.

If they clog a sewer line and sewage is backing up do they not get charged? That is a question of safe and habitable as well. Do you have to fix that at no cost to them?

That's the angle I'd take. All past damages they cause are considered rent outstanding. They are now late on rent and start the eviction process.

I've read some tenants have sued their landlord because their children got bitten hundreds of times by bedbugs in their rental unit. The judgement against the landlord, millions.

Here in California, a landlord "must" eradicate the bedbugs. Only if the landlord can prove the tenant was responsible for the infestation, then and only then the tenant must pay back the landlord.

I had a case here my tenant allowed her sister's family and pets to stay over while their house was being treated for bedbugs. The sister family infested my rental unit and I had to pay lots of money to get rid of the bedbugs. When I learned my tenant has her sisters family stay with her I checked their application and got the sisters address. I spoke with the neighbors and learned the sister had an bedbugs and got her house treated and that's why the sister's family stayed with my tenant.

I found out the insurance company from the mortgage company and then filed a claim for my costs, stating I was going to sue them for bringing the bedbugs to my unit. I collected and they evicted my tenant for cause. Filing a false complaint with the city that I was responsible for the bedbugs knowing it was her sister family and pets the brought them over....

So you must deal with the bedbugs and then try to collect afterwards or during.... --47.156.xx.xx

This building and no other building has ever had bedbugs. I found out on a Saturday that they had bedbugs and I called to schedule the exterminator Monday morning and he came that Thursday. Thanks for the help. --71.112.xxx.xx

In ontario the landlord has to pay regardless of how many times the tenant brings in the bedbugs....and the tenant can sue the landlord if the bugs arent removed quickly. --70.31.xx.xxx

I tell all my tenants who encounter bedbug issue that bedbugs don't travel if anyone is living in the unit.

I gave new tenants 1-2 weeks when they move in. If the unit had bedbugs, then they would have got bitten within couple days.. Use this fact to get them understand that it is their responsibility. --71.232.xxx.xxx

Check your state laws. Many states require the LL to pay for BB in multi family (2 units or more) since it is difficult to be certain who was responsible. --71.75.xx.xx

ignore other states telling you it's on the tenant. in a multiunit building, you are the one footing the bill ... doesn't matter the circumstances.

that said, in a circumstance such as this one, if they are collectible, which I'm guessing they are not, I'd sue them in small claims and let the magistrate decide --72.70.xxx.x

In Pa, if the place is a MF dwelling - the LL typically pays to get rid of any infestation......bed bugs, mice, roaches or crappy tenants - all the typical menaces for LLs --72.23.xxx.xx

"These regulations do not apply to owner-occupied dwellings or to single-dwelling rental units. The regulations also do not apply for an individual unit in a multi-unit dwelling if it is the only one infested with bedbugs. The occupant is responsible for treatment in these settings."

This was from Chester count PA, don't know if it applies in your county. This was referring to Housing regulations when dealing with pests. But look into it before assuming you must pay. --107.5.xxx.xx
