JB,Back in the day before insurance policies excluded lead in there policies I was sued for $90 million for lead.State Farm hired a pretty good attorney and he proved the kids got lead at 2 houses before mine and all that accomplished was that those owners got dragged into it and there insurance policies ended up paying for it also so it didn't get me off the hook on that case. --72.231.xxx.xxx

I had an applicant from the projects that were owned by the City but under an LLC. The tenants in that housing community were all exposed to high levels of lead dust and particles. Not to mention when they replace the roof's, they thew the roof down to a dumpster with no shoot. So knowing that the State gives any child a free blood test and lawyers are waiting to sue landlords, I turned down the applicant telling them that another family who applied before them took it. --47.156.xx.xx

Seems odd they would state that on an app. Wonder why.

Are they claiming this as a handicap?

Tread carefully. Odd stuff can be Fair Housing testers.

This could be a great "what if" question to your Fair Housing director.

It was someone trying to help an employee find an apartment on a facebook rental site who put right on there that a kid has lead and of course needed a landlord who would wor with them and help them and it got me thinking,turned out it was a friends apartment they are leaving and my friend called me for help with the eviction because they threatened him with the lead thing when he started the eviction for non payment of rent,clearly I could deny for eviction but I started wondering if I could deny for having lead? Everyone who says no under what provision of fair housing would you say protects them? --72.231.xxx.xxx

I guess you could say that you are not certain your place is lead free and don't want to endanger the health of the child in any way. What parent would endanger their child... don't answer that!

I discouraged a woman with a small child who told me she wanted to get out of the city to safer place, that my country farmhouse with a pond and barn is not the place to bring a child. The barn has all sorts of animals in it. But I knew that city residents really don't understand country living. It seems so idyllic to them. --108.44.xx.xxx

No. Absolutely not. You can't turn down an application because they have children and you have an apartment that hasn't been deleaded. If you write this down as the reason you are turning someone down, you are asking for a lawsuit (both for breaking the law, as well as being stupid). --71.233.xxx.xx
