State Specific Question About: MICHIGAN (MI)

Is the landlord required to pay for spraying for bedbugs, when the tenant brought them in by purchasing used furniture? According to the pest company, the tenant admitted to them that they recently received a used mattress. Bill for spraying was over $400.00 and that's only the initial application, there will be subsequent bills for more applications, if necessary. Initial tenant communication was them attempting to say that they are from neighboring units, however, no other units had any signs of infestation. Have never come across bedbugs before, so not sure how to approach this. --73.144.xxx.xx

This is mainly driven by your lease. Local/state laws may apply as well.

Last time I had them, the bill was $600. That included as many sprayings as it took though. They ended up treating twice and problem was gone. --98.175.xxx.xxx

In multi-units, it may be LL's responsibility since it is difficult to prove where the problem originated. This is where it is important for the LL to know the state laws and craft his/her lease accordingly.

No matter who pays this time, be sure to fix your lease so that any tenant who brings in used mattresses, box springs, or furnishing is responsible for any pest infestation in the unit. It might not fly if taken to court, but it's better to start negotiations from a position of strength and to deter unwanted behaviors.

We use Sen-Sci volcano traps prior to moving in new tenants to verify there is no existing bed bug infestation, and per our lease that is written in compliance with Missouri land lord tenant statutes, the tenant is responsible for all costs due to bed bug treatment. --68.188.xx.xxx

My City states it's the LANDLORDS responsibility to eradicate bed bugs and afterwards if one can "prove" it was the tenants fault, then maybe you can make them pay.

I had a tenant in an apartment allow her sister's family to stay while their home was being treated for bed bugs. The sister also brought with her to the apartment two invested dogs and a cat. Then shortly after moving back home, my tenant complied to Housing they have bed bugs and don't know where they came from. Lucky for me on my tenants applicant it has the sister as an emergency contact with phone and address. So I drove by and spoke with the neighbors and got the business of the company that treated the home for bed bugs. Then I drove to the company and said I got the homeowners recommendation and got a copy of their bill.

I had to take my tenant to small claims court and won. Then I had to put Housing and the Health Department on notice that I was not the cause and it was the tenants fault. I made them put that in their report...... --47.156.xx.xx

By admission the tenants should be billed in the next rent cycle - yes the whole amount and follow the treatment of laundering everything then into large tuppwerware totes or at least garbage bags, have them arrange payment when the bug guy arrives next time - if they flee in the nite the deposit will be charged to finish solving this problem. --76.188.xxx.xx

I would document the comments about bringing in a used items and add the $400 to their account letting them pay it off over a few months. If there is a law contrary to that let them find it.

there was a similar question on this a few weeks ago. I was curious so I googled it. Seems that many states and municipalities consider it the LL while others do not. However it seems as though multi's almost always fall to the LL probably because it would be difficult to impossible to determine who caused it.

There was nothing in our lease,never had an issue before, and honestly, these are upscale apartments, never guessed we would have. There is a bill that's going to be voted on, on July 25th where the responsibility would be the tenants, if they brought the bugs in. These people have been residing there for 4 yrs, and again no signs of any bugs in any of the other units, plus their admission that they got a used mattress...The current law here is stating it's LL's bill, glad someone is making a legal argument that it shouldn't be, and fingers crossed here in MI that it's passed. We didn't rent an infested unit, it shouldn't be our bill, if they are negligent in what they bring into their unit, but according to current law the bill is ours to pay. --73.144.xxx.xx

My understanding of MI law is that it is the landlord's duty to provide housing free of vermin. Bed bugs may spread, so it is the duty of you to now make sure that doesn't happen. I have never found any MI law specifically mentioning bed bugs. Bed bugs are not a health concern, other than causing mental anguish.

However, since they brought them in (used mattress would be THE #1 way to bring them in) I'd still bill them. It would be the same as if to say someone broke off the door to a common entrance. It would be safety issue since anyone could now get in. So you fix it, you pay it, then bill the culprit.

So you ensure their place is treated, you can pay, they pay you back.

News will spread, and someone will get a mosquito/spider bite and claim it is a bed bug and break their lease. Get ready. --107.5.xxx.xx
