I went by my property and see this huge tree toppled over. It sits on a wooded lot. I call the county and was told it’s own by a private owner and was given the address. How would you handle? I have done a google search, white pages look up but no success. Would you go to this man’s house? Should I file with my carrier and let them subrogate? I mean this is a huge tree. No damage to the inside. Landed on my ac but still runs. Also hit my gutters. Not sure if any other roof damage. Thanks --166.137.xxx.xx

The part of the tree that fell on your property is now your responsibility.

Good chance the owner will not care about the part on his land. --73.152.xx.xxx

Unless the owner knew the tree was unhealthy, this is considered an act of God/nature and he is not liable for your damages. You can file with your insurance or repair your damage yourself.

I had a tree fall down on the property line between my house and the neighbors. It didn't damage my house, but was partially on my lot. It did damage the neighbors house. I just waited a while and the neighbor removed the entire thing. I think they filed an insurance claim because of the damage to their house. --73.102.xxx.xx

You lucky devil! You now own every part of the tree that is on your side of the property line. You get to keep all the wood, leaves, and nuts/fruit. --68.156.xx.xx

AL,

Do not file with your insurance. The damage to your house is minimal, under your $1000 deductible.

Offer the tree on CL - "Free wood, you cut".

I would also send a letter to the other land owner politely demanding he remove his tree. Many will.
