State Specific Question About: CALIFORNIA (CA)

Neighbor called that branches from tree on my property with branches hanging over her property needed to be cut. I have always cut branches, flowers, weeds, ivy, etc. that were from neighbor's property on my property.

What is correct response? --67.187.xxx.xx

"No problem! If they're in your way, please feel free to have your guy take care of it so that it gets done the way you like it."

But if I have my guy cutting stuff away for me anyways, it's cheap goodwill to have him spend 15 or 30 minutes taking care of stuff that affects the neighbors, depending on how significant the growth is.

I had one tree on my property that was scraping up the neighbor's shed roof. It took my guys about 30 minutes to clear all my branches off their roof--- poof, instant goodwill. Later, it turns out that the neighbor's parents and brother ended up renting my house next door!

Another neighbor elsewhere had a tree on their property that had significant overhang on my side of the property line. When my guys were trimming it back, the neighbor asked if they could trim the branches all the way back to his tree, instead of just to the property line. Sure, no problem. I had my guys take care of it the way that made him happy. Then he asked if my guys could take care of the limbs on all the other sides of his tree! I said, "What a great idea! Since they're already here, it would be easy to ask them how much they'd charge for something like that." :P Guess who didn't talk to the yard guys after that! :P --96.46.xxx.xx

When your tree branches grow over the property line/fence, your neighbor is free to trim back any over growth that extends onto her property. You need not pay or cut those branches.

My home has a huge lot with 7 neighbors around my property line. As a good neighbor I have always have my landscaper trim back branches growing over to my neighbors property. BUT one neighbor decided to keep my tree's overgrowth a secret for several years until we had big winds and my tree branches grew over my neighbors roof. Now that it was an emergency, my neighbor let me know. It cost me $850 to have those branches trimmed and hauled away.

From that point on I let my neighbors know that I'm not going to be so generous anymore. --47.156.xx.xx

be a good neighbor and take care of your own trees/bushes. I'm not talking about them legally being allowed to cut back to the property line ... it's yours and you should not be imposing your tree on someone else to deal with. what's legal and what's right are often two different things. --72.70.xxx.xx

She is allowed to cut whatever is hanging over but in my experience she could cause a lot of damage. If they are very large someone may have to come onto your property and climb your tree. You have to assess whether you want someone in her employ to mess with your tree and potentially harm it. If they can be clipped with a clipper, tell her to go ahead but stay off your property --73.178.xxx.xx

My question is "who pays?"

Trees trimmed about 6 months ago. She says she wants branches on her side trimmed again and wants me to pay. Trees are high and need professional.

Robert says she pays, Nicole says I should pay.

Considering both views, I am considering cutting trees down as I don't want problem. Another person I know ignored requests from neighbors and got sued. My branches on neighbor's property are not near anything that they could damage. --67.187.xxx.xx

this is a whole different issue now. If trees were trimmed 6 months ago, they shouldn't need it again. Figure out what the real issue is. --72.70.xxx.xx

sort of but not really off topic.

when I have the spouts cleaned on my personal house, I have one side of the neighbor's house also cleaned as what goes in those end spouts are a direct result of a big tree I've got. when I had the tree trimmed last fall, I had him cut not just "my side" but the entire tree ... and that meant what was over the property line also. --72.70.xxx.xx

If they've been trimmed in the last six months, just tell her, "It's the wrong time of year for tree trimming. Trees need to be trimmed at the coldest time of the year, so they don't get damaged."

But there does seem to be something else going on. See if you can get her to tell you what the real problem is. --96.46.xxx.xx

Is this like what is going on with the left harassing the administration as in political?

If she cuts branches she pays. If they are up high and not where her head will hit them then they are not a problem unless they are huge and look like they will fall down on her in the yard. She pays. --73.178.xxx.xx

I grumbled every year for the past 6 or so when the neighbor's evergreens and assorted junk trees that grew within them thrust their branches over into our sfh rental yard.

Then a n'orester blew them all down. "Aw, that's too bad." I said to the owner, quietly applauding within because they blew over into his yard, not ours.

I was even happier when the tree removal dudes removed all the junk tulip poplars, wild cherries and sumac, too. Yay! --71.175.xxx.xx
