State Specific Question About: NORTH CAROLINA (NC)

My HUD-supported tenant has become increasingly unstable. She cursed my repairman and told both him and me he could never come on the property again. She imagines that each time she goes out of the house, someone breaks in and steals items (small and odd things like jars, paper towels, etc.). She has implied that I am either the thief, or that I am cooperating with the thief. Yesterday she called and told me angrily over the phone "You shut up, you shut up and listen to me!" I decided to listen carefully so I could figure out what was on her mind. During her rant she told me that she sleeps with a gun beside her every night, and made the statement "I'm going to wind up shooting someone." Although she also told me that she is looking for another place to rent, that's going to take some time. I am afraid to go onto the property now and have warned the tenants who live near her to stay away from her house. I've called the Sheriff who is unhelpful. What can I do in the meantime while she is supposedly looking for another place to stay? --64.53.xx.xxx

Don't go there. Call Hud office and talk with her case worker. Read the post below about Tenant Health Declines. Don't go there at all, let her calls go to voice mail and call her back the next day when perhaps she won't remember why she called. Don't prompt her memory either! --99.203.xx.xx

Oh my, she probably went off her meds and is riding the high of her mania and or illness. Ditto to what Plenty noted, and your request will be documented to hopefully flag that she should not be in your unit near other tenants.

Here, we can call the police and report things like what she said, especially the "I am going to shoot someone" part of it and they will come out and possibly one of them would get shot trying to take her to the crisis center at the local hospital. --73.178.xxx.xx

Don't go the media route. They'd most likely make it a heart warming story about landlords deserving to be shot. You don't want to risk garnering sympathy for this woman.

Since she threatened to kill you already, you could get a restraining order against her. Might help with your eviction. Threaten to sue HUD for endangerment by placing this tenant in the system. I'd be calling HUD everyday demanding to fix this problem.

Cash for keys might also be applicable in this situation to hurry her decision up in finding another place.

I had two tenants go off their med's and went crazy. One tenant called the police and said I was trying to break into her unit because I wanted more kids and she would make the perfect mother. When the police showed up to take a report, when my tenant answered the door the police asked to speak with her daughter or granddaughter. My tenant was 94 years old and lived alone. The police called her doctor and was told to count her pills finding out she stop taking them because of a surplus of pills. A few hours after taking her pills I got an phone call from my tenant, she had apologized for accusing me of harassment.

The other tenant called me because I hadn't refunded their security deposit. She was still living in the unit and had never given me notice she was going to move. Until she switched her medications, she was impossible to deal with. --47.156.xx.xx

Labeling people with a medical diagnosis without actually carrying out any testing can be construed as slanderous, libelous and probably dangerous.

Unless you have actual evidence of some kind of mental health condition, the best you can do is say that she's unreasonable, threatening and perhaps abusive.

Send the obligatory cure or quit notice for failing to allow access for your maintenance crew and offer upgraded security (at tenants cost) against unauthorised entry.

Advise HUD office and law enforcement that tenant has a firearm and has threatened to use it.

Not all kinds of crazy are cured by meds; not all kinds of crazy are brought on by lack of meds. This could just be regular anti-social crazy. --98.229.xxx.xx

I am very grateful for the responses to my question. There is good advice offered here and I'm certainly taking it to heart. I've have advised HUD of the situation and am waiting for a call back from the employee there who knows my tenant best, hoping that she can throw more light on this situation. No matter what I'm told, though. I want this tenant out of my property and have begun the eviction process. If I am forced to go onto the property, I will have to be accompanied by a deputy. I have been in the situation in the past where the police do not want to get involved. This was during the time my special needs son was living with us and increasingly violent and had periods where he was out of control. I had good success in sending the police captain in my precinct a certified letter officially notifying them of the risk, with a copy to our chief of police.

I got a face to face meeting with the police Sargent, he was very understanding and polite. The police came up with a plan to handle the situation when it arose to everyone's satisfaction. They would take my son into custody (but not arrest him) when he was out of control, sometimes transport him to our mental health crisis unit. I was later told the police were helpful in getting my son placed in a long term psych hospital through an interagency meeting. This was in Tacoma, WA, a medium large city.

You cannot expect the initial responding officer to know what to do in these situations. Go up the chain of command and keep everyone safe. The police really are the good guys. --98.146.xxx.xxx

HUD finally called me back. Turns out this tenant went to see HUD 2 weeks ago at which time she was given the forms she needed to find a new dwelling. The HUD agent told me that she knew at the time my tenant was deteriorating, and that she, the HUD agent, felt threatened herself! (But didn't do anything about it). HUD agent told me to go ahead and send the 30-day notice because the way things stand now, if there were an emergency repair needed, I have no way to go onto the property safely. She and I also agreed that we are independently making reports to DSS-the Adult Care department. I have made my report this afternoon, and DSS told me they wouldn't tell the tenant I was the one who called. --64.53.xx.xxx
