Based on wacky court decisions of late, the landlord can also be held liable, for allowing the tenant to reside in the rental. Those who file a lawsuit are looking to obtain a monetary settlement from those who are perceived to have the deepest pockets ... which unfortunately, appears to be "all of us" property owners. --99.203.xxx.xxx

The "visitor" will retain a lawyer, who will try to make money anyway he can.

You responsibility will be determined based on a variety of facts.

Perhaps you may consider picking up the medical bills not covered by their health insurance. My first call in either case is to my insurance company. They should take it from here. My guess us you did not tell/instruct the dog or tenant to act in any certain way. However you are a part of whatever happened. Not normally. The two reasons a LL can be liable are if you knew the dog was a danger to others and if you knew and had the power to have the dog removed from the premises.

Depending on the breed renter's insurance will cover dog bites. State Farm has no breed restrictions and that is what we require our tenants with pets to have. --71.75.xx.xx

ignor it until it goes away. Play like a politician and deny deny deny any responcibility. No contact-- always contact my atty---- no letters no nothing except call the property atty. We've had many claims for dog bites or steped in hole in yard slipped on stoop-- yada yada yada.

I encountered a biting dog the 2nd day I could walk on crutches last October - catchy phrase from the board of health, now since the dog bit someone it is a vicious dog and must stay in quarantine (dog jail) to prove all the shots and treatments have been administered at the dog owners expense. So back to the dog converted vicious by it's actions, whoever provided the dog must now keep it off your property forever, maybe the tenant or visitor, no amount of insurance will change the habit of a dog. --76.188.xxx.xx

If you allowed your tenant to have a dog that can cause injury to another AND you knew the dog was aggressive and still did nothing to protect others, you could be held liable.

When one of my tenants had a dog escape and bit a child on his leg while riding a bicycle I was sued by the children's father as the landlord who allowed the dog to live there.

I presented proof that I did everything I could to protect the public. I had the dogs medical records showing it was licensed and had it's shots. I had a certificate that the dog went to school and had obeisance training. I provided locks for the two wood gates and chain link sliding gates to secure the property. The tenant left the lock off of a gate to allow a family member to come by and borrow a jet ski. That's how the dog escaped. I was found not to be responsible.... --47.156.xx.xx

I checked with my insurance agent on this topic ages ago. He said as long as we had a clear animal policy forbidding aggressive dogs, we were okay if something happened (of course assuming we actually didn't ALLOW an animal we knew to be aggressive!) --50.82.xxx.xx
