State Specific Question About: NEW YORK (NY)

My tenant is living on a month to month basis. He owes me $11,000 in unpaid rent, paying less than the rent amount or skipping at all.He just paid less than half the rent, in two months. Never picks up phone or return calls. Never answer the door bell.

Oh my.

First you need to evict him. Then there is another legal actual required to receive a judgement that can be sent to collections.

You have allowed him to fall so far behind it likely won't qualify for small claims court.

I'd take action now to evict. Don't fall into this cycle again. Take action the first time they fail to pay. You don't do yourself any favors by waiting and all you do is help them to fall further and further behind to a point where they can't and typically have no intention of ever catching up. I have a friend that inherited 5 rental units from their father. Since the father was sick during the last few years of his life, all of the tenant fell behind in their rent.

I gave my "friend" the legal advice on how to proceed. She thought she was being smart and kept on accepting payments every week, also with a constant balance between $5000 AND $10,000 PER TENANT.

So she allowed me to go forward and deal with her worst tenant, a pack rat with a doctors note. So I had a talk with the tenant and offered to help clean the unit, offer declined. Then I wrote the tenant a letter stating their living habits were dangerous and violated fire and building codes. I gave the tenant 60 days to improve things. I returned with my camera and documented there was no progress. So then I reported them to the Fire Marshal. I was given notice that the owner had to clean the place up, get the tenant to clean the place up or evict.

I then filed for eviction. The tenant and doctor showed up in court with excuse after excuse. But since I had tried to work with this tenant and his living conditions were shelf made and wouldn't clean up, the Judge gave him 45 days to clean up or move out.

So in short the tenant kept on making payments until I started the eviction. I got them out. I then had to fix up the unit and re-rent it.

In short. This is the only unit owned by my friend that:

a) The tenant pays the rent on or by the first of each month.

b) The rent is at a market rate while the other rents a way below market.

c) With the extra rent being at market, the extra income in just over a year paid for the eviction attorney and re-model/repairs.

SO I say evict them and get a new tenant who will pay on time. Still sue your tenant for back rent....but don't let them live there anymore. --47.156.xx.xx

Please do yourself a favor and hire an experienced eviction attorney Monday morning. Let him/her handle everything until the tenants are gone.

During that time, if you really think you want to continue as a landlord, spend your time studying your state and local landlord-tenant laws. Learn to screen and manage properly. Keep coming back hear to post, read & learn.

I am unfamiliar with NY laws but in NC I can file for eviction and a money judgement simultaneously. However, they will only give me a judgement if the tenant shows up. If they do not then I have to file the money judgement at a separate hearing where they will issue the judgement regardless of whether the tenant is present or not. --71.75.xx.xx

NC INVESTOR- In NY we file for both the eviction and judgment at the same time,if they are not served personally and do not show up the judge is not supposed to grant the judgment although we get the eviction but many of the non attorney town and village judges don't know any better and I get the judgment from them --72.231.xxx.xxx

Hire an EVICTION atty who SPECIALIZES in evictions in your court on Mon am. NOT a general atty.

Yes, I'm too nice/naive/stupid to be a landlord.

I have retained MIZRAHI LAW OFFICES, LLC. of New York.

IDK,not much time to research attorneys. Getting nervous now.

They appear to be good because they specialize in landlord-tenant case and claim to be very experienced.
