I want to install a new fence for a SFH rental. There are neighbors on both sides and in the back of the house is a canyon, so no backyard neighbors.

There is an existing old chain link fence about 4 feet high between the neighboring houses. I asked one of the neighbors if he wouldn’t mind me removing the old fence and replacing with new fence and I’m sure the other neighbor will agree too. My question: is there a “permission slip” that I should have the neighbors sign? --76.238.xxx.xxx

Sadly, even here, in the state of NC, we need a permit to install a fence. This has become my "go to" example of the governments overreach with regulations.. (ie...something that can be installed in a day-ish...removed even quicker)...needing approval from big bro .) Ugh.

That being said. I realize that I am talking to someone from CA. If even a fraction of what I read online is true...I would have run years ago.

I honestly don't know about a "permission slip", but I understand where you are coming from. See which neighbors are homeowners and approach them, about your plan, w extra politeness.

In my experience, the only way a municipality gets involved, is because a "neighbor" complains, and your project gets on the radar.

Just ask the neighbors out of courtesy. Set your fence, well into your property.

To avoid the need of a permit I suggest changing one side now and the other sometime near halloween - this would be a repair in my area, if you were starting from scratch you would need the surveyor blessing. --76.188.xxx.xx

I don't know which county in NC you're in but in Mecklenburg we do not need a permit for a privacy fence. We do need a survey but that isn't governed by the county. --71.75.xx.xx

Because here in California we have more ambulance chasing lawyers per square mile than other civilized states i would send a letter using the tracking method to confirming any verbal agreements.

Take pictures of the old fence where it needs repair or replacement. Then get at least 3 estimates on replacing the 4' fence with another 4' chain link fence and the difference between a 6' Fence. Then approach your neighbor and ask if they are willing to split the cost to replace the fence at a 6' height. If not then half the cost of a 4' tall fence.

If the neighbor won't pay anything towards the replacement then write him a letter expressing that the neighbor doesn't want to share in the cost to replace the old fence and then ask FOR PERMISSION TO REMOVE AND REPLACE THE FENCE WITH A 6' TALL CHAIN LIKE FENCE LOCATED IN THE SAME LOCATION. Get the neighbors permission in writing.

Most neighbors will allow you to replace the fence at no cost the them-self. --47.156.xx.xx
