I don't enforce lease clauses to the minute, but I certainly enforce them to the day taking into account holidays and weekends. How many times though, do you enforce zero tolerance before enough is enough? I have a tenant in a building who has been late every month since they've moved in. I have threatened eviction a couple times and they have paid. I have filed eviction a couple times and they have paid. This month they bounced a check. Now keep in mind, I am still within my timeline for my zero tolerances, but when do I cut it off. The reason I deal with that with this one tenant, is because I truly believe that you always have one bad apple in the bunch. And I've seen that so far most of the times to be true. So do I keep stringing these guys along or do I boot them?

Others may disagree, but to me zero tolerance means you have a set of policies and you stick to them. Mr. LL recommends having any exceptions to policy formally written down as well to avoid issues with claims of discrimination.
So whether your policy is you continue to accept late payments up until the day of court an unlimited number of times, or if you take a "three strikes and you're out" approach after you file eviction the 3rd time regardless if they pay, just set your policy and stick with it.
My policy is rent is late the day after it's due, fees begin immediately and are not waived, and I file on the 7th day at 11 AM (or the next business day if it's a weekend) after rent is not paid. I will continue to accept rent up until the day the judge grants me possession. Once that is done, I do not grant extensions: they're moving out or I'm moving them out. This conforms to my state's LL/T laws and also is enforced by our local judges.
My exception to this policy is if the tenant has also caused damage and it is not paid. Then I file the day after rent is due and not paid. It's all written down, and I stick to it. --173.19.x.xxx |

I think everyone here has had to deal with a slow payer just like the one you describe. (I inherited one on the last house I bought from another LL). Yes, it is irritating when I have to post a P/Q notice every month to motivate a deadbeat to either pay rent or be evicted.

I am taking a check from them as a result of several failed attempts to get them set up on clearnow auto draft. They did the paperwork that they could to the extent that they understand the process. NE, reading your post really brings out the futility of dealing with late payers. They don't improve, they take up our time, and we will wind up dealing with judgements and garnishments from these same people.
Whenever I have similar type tenants, I view it as a screening failure, and apply the lessons learned.

I have one slow payer. Been there since 2009. They pay on the 5th day (just before late fees can legally be charged.) But they always pay. I'm not even sure a judge would LET me evict them. But they are now month to month and when we get a moment to breathe (their place needs work...) we will just issue a non-renewal. They pay mostly in cash (servers) so have to get to the bank which is not always convenient (no weekends hours!) For now we just go along as we have always gone along.
I have one other entitled surfer dude brat that pays by bank transfer so could be done at any time. Almost always waits until the 5th. Always waits to pay his water bill when he gets a final notice (and the water company HAS imposed late fees by then.) Probably pays all his other bills right on the cusp as well.

That's one of the reasons I do month to month. If I ever have to write a third pay or be evicted, I give them their 30 day notice to vacate... except of course, in Oregon it is now a 60 day notice to vacafe, and the town where I have just sold all my rentals, just passed a law requiring a 90 day notice.
So if they pay late, they get their 90 day notice to vacate. But not from me; I've had enough and quit the rental business in Oregon before they make the entire state pay relocation money and not just in Portland.
OP, if you are getting your money, it would be easier to just not renew their lease. Getting a judge to evict for paying a bit late, but paying, might be difficult. --174.216.xx.xxx |

I may start a new policy in house that if I file an eviction on a tenant, they get a notice to vacate as soon as possible or when lease is up.

Your post is a perfect example of LLs trying to juggle, creating stress, and eating up their time and energy.
"I have a policy but I don't really follow it" is what I hear soooo often as the LL tries to justify with phrases like "but they pay the late fees."
I understand bending for a clean res who does eventually pay. But at what cost to my stress?
If this is a non-stress situation, roll with it BUT take into account the time you have to invest to "allow" it to roll.
Me? I stopped playing god, stressing over the decision as to who is worthy of a slide, who is lying, how much does he owe this time, did he call. did he go to the trustee for help....
I implemented the same policy as WalMart - pay for what you want when you want it. (they even have people standing there, ready to take your money!)
Can't pay for a month of groceries? No problem, get a week's worth and come back for more with your next paycheck.
What's your time worth? How much of your time has this res eaten up? Hassle factor?
I know you like Jim Rohn. I love his example of "take it times 1,000." Not sure about a decision, multiply it by 1,000 and see if you like the answer. If you had 1,000 res like this guy would you be happy? Profitable?
Did you put him on weekly PayDayPlan?
Some larger employers will pay the employees bills from their paycheck as an ACH.
Monthly is next to impossible in today's economy.

We have one fellow that pays late every month; we have had to do 10 day letters a number of times. We have even filed for eviction 3 times. He always pays late and pays any and all extra fees that we charge.
Outside of the aggravation, we figure we have made a lot of extra money on him. So he might as well pay late, and get the extra money from him as long as we can.

Ok that's fine. That's practice of zero tolerance that I don't really need to draw the line at.
These bozo's today, Late EVERY MONTY since they moved in, but with progression. They've been there maybe 6 months. Paid late with fees, then pushed it past the cut off date to where I filed. Then they paid with the late fees and the filing fees. This month they paid with the late fee and bounced the check then stood me up today when they were to meet me to make good. This will be the 3rd eviction filing in 3 months in a row.
Nope. Game over.
