New tenant moved in beginning of month. The 1st was on a Tuesday. I let them move in a few days early ( Sunday) because they work all week. They did not have their proof of Renter's insurance on that Sunday. Said they wouldn't have it until Monday or Tuesday when agent was open to send it to me. It was a quick process from original showing to move in, so it made sense . They qualified so I was good. I didn't worry about waiting a few days for the proof of insurance. What an idiot I am. It has now been 2 weeks and no proof of insurance. They don't even have to pay for it, they just have to set it up. I have called, emailed and texted and they are ignoring me. It's not even about the insurance anymore, I am not going to set a precedent where the tenant makes the rules. My husband wants me to let it go. Of course, he insisted I do a year lease instead of my holy grail month to month. So now I am stuck with these people for a year. It is killing me not to send a Notice To Quit. Husband doesn't want me to because of upcoming vacancy in building. I have learned my lesson...about listening to tenants and my husband. I don't care if they cover their stuff, I just want the liability end covered. I am tempted to give their phone number to every insurance salesman in town to get them motivated. They already complained that they don't like the way rent is collected and they would like their rent picked up at their home. I declined. Im thinking that since they think they make the rules, they will expect their rent will be picked up. It will give me great pleasure to have them served for non- payment. Maybe I'm overreacting because I'm displeased that they are ignoring me. Like I said, it's less about the insurance now than it is their behavior. Am I overacting or do I need to nip this now before they start moving in the pit bulls , trampolines , pools, fire pits and in laws? --71.10.xxx.xxx

I threw out a lady after 10 days into a 2 year lease. She was a payer too. One of the best decisions I've made in awhile. Your gut is telling you to get rid of these people or enforce your rules.. cave now and they'll understand you'll cave on other things. If your lease or state allows it, send "Notice of Lease Violation". My lease states 7 days to 'cure'. If not cured within 7 days, I have the choice $$ per day penalty fee and/or terminate the lease.

A partner complained to me many times that I accepted a tenant that wasn't perfect. This tenant had the nerve to cut the grass when ever they thought it needed cutting opposed to trimming it every week. The tenant wife when she pulled up the mini-blinds, they were never level. Also when they took in the trash cans after pick up, the were never in a straight line.

My partner was headed to a nervous breakdown over these earth shattering issues. He and I had only 20 or so units together while I had 100 more by myself. So I decided to show him what a real problem was. I took him for a ride in a gang infested area where I had an 10 unit building. He couldn't tell what color I had painted the building because it had too much graffiti sprayed all over it. He asked how long did it take for the building to get this way. I told him I had the "city" repaint the building white under a special program. That was a few days ago and now it's back to being graffiti-ed. The partner finally understood that his issues were of no importance and he'd have to let them go or sell me his interest in the property. But with a monthly profit so large that it covered his home mortgage, he'd be a fool to let the property go.

So take your tenants issues with a grain of salt if your getting the rent paid, paying down the mortgage and having your tax write-offs. --47.156.xx.xx

Read your lease agreement again.

1. What does it say about where and the way rent ought to be paid? Check in the mail? direct deposit? What ever is written in the lease they signed, that's the way it has to be, unless changed by written mutual agreement.

2. My lease recommends, not requires, tenant's insurance. Like Ken said, what do I care about their possessions?

3. Maybe they ignore you for being a bit too intrusive?

4. Relax, and if you can't sleep at night because of your tenants, evict them if and when they fail to pay rent on time. --99.59.x.xxx

No need to beat you up: you did a fine job of that yourself.

We all have to re-learn lessons sometimes. I recommend having a Move-in Checklist going forward. Item number #10: "Proof of renter's insurance received." The last item on the list is "Hand over keys." Then you simply follow your list: no exceptions. If they whine...."This is company policy."

As far as what to do right now: you can always ensure you have proper liability coverage set up. The only reason for tenants to have it is if someone gets injured the plaintiff's attorney will most likely sue THEM vs. you, or if you do get sued and lose or have out of pocket defense costs, then your insurance can try to go after the tenant's policy to get reimbursement, which would keep you from having increased premiums or policy cancellation in some cases.

Other than that, it's up to you if you want to boot them or not. I probably wouldn't. Regarding rent: "This is our rent payment policy." If not followed, evict for non-payment, as you said.

Don't fear vacancies. The day that happens, you're really and truly screwed because the tenant is in the driver's seat. Knowing how to get 'em out and re-rented promptly is your best defense.

Thanks for the great insights. They did not complain about rent collection until after they had moved in, I never would have taken them if they did. No way am I catering to them on that. I know I should pick my battles, but " you get what you allow" won't get out of my head.Ive always been very successful by being no nonsense and all business. I am with those that don't care if my tenant's have rental insurance. I had lightning strike once house, really didn't do much damage to the house, but did travel through the Christmas lights to the electronics they had. Toasted them. They learned after that. I do remind them my insurance does not cover their property and recommend tenant's insurance. One of those things I don't worry about. Even if they have liability, pretty much claims are against my policy because, hey I am the rich landlord. I have plenty of insurance that I can sleep well at night. --108.44.xx.xxx

Does it specify in your lease that the tenant must purchase and keep current a renter's insurance policy? If it doesn't, you are stuck.

If it does, send them a written notice that they are in violation of their lease and they have 72 hours to correct the violation or you will file for eviction.

Although, I have to say, I have trouble imagining any judge granting an eviction because the tenant hasn't purchased renters insurance. Some judges don't even like to evict for non-payment, giving months and months of second chances. --174.216.x.xxx

Go over with eviction documents, knock on their door, and explain "This just isn't working out for me". Then just hand them the documents and then be absolutely silent and still.

When their shock wears off a litte, then explain just exactly how it's going to be.

You have to pull tenants like this up short and early or they will think they are in charge.

-Because it helps weed out the bad tenants and tenants who are higher risk. Bad tenants arent going to buy insurance. Responsible tenants will.

-if tenants have to relocate due to an emergency, it is likely they will look to the landlord for compensation of accomodation, stress, anguish ect ect ect and in ontario they get free lawyers to sue the landlord. If the tenant has insurance then this cost is covered. The same goes for the tenants belongings.

-If a tenant causes a fire, flood, their dog bites someone, ect and they have no insurance.........its the landlord who gets sued here.

I now, ONLY take tenants who have renters insurance. In Ontario its smart business. Its a protection that the govt actually lets landlords have and we would be foolish not to require it. --65.94.xxx.xx

You said they don't even have to pay it, they just have to set it up. That makes no sense. It gets paid when it gets set up.

What does your lease say? That is your only recourse. If it's not in the lease you can't do anything.

Also, forget about evicting them unless you have something that is actionable. If you don't pay the rent, in most states they have time to cure that. The same with most other violations.

Doesn't your lease say how the rent is to be paid?

Don't cave in to your husband unless he actually understands what it takes to manage a property. My husband was often wrong where my interactions with MY tenants were concerned. We have 2 houses in a Spanish neighborhood & I don't speak Spanish. He does the translating. Unfortunately, he felt that since he was part owner & the translator, this gave him the right to make decisions on tenant issues. Took me years (& banning him from participating) to train him otherwise.

You can't make exceptions for one tenant that you aren't willing/able to make for ALL tenants.
