I got an email from my RE agent asking me to sign an “exclusive right to represent the buyer” form. This looks like a standard realtor form.

I have bought about 10 class c properties and 1 class a property from him over the past few years. I also buy properties from auctions, wholesalers, other LL, etc.

If I buy a house from the mls system, I have used this agent.

What is this form? Is this standard practice?

I believe that it will bind you to him. The devil is in the details.

If it were me I would not want a tether, but I would strongly consider using him [if I was pleased with the value that he brings] on a regular basis.

If you buy properties from auctions, wholesalers, other LL, foreclosure sale, FSBOs, etc. you will owe this RE agent a commission. I would not commit to promising him a commission from non-MLS properties. --100.6.xx.xxx

At this time, I am unwilling to limit myself to exclusive representation across all purchases. I prefer to work on a property by property basis. I will happily sign a buyers agency agreement for any property where you represent my company.

If an agent asked me to sign that agreement I would probably stop using that agent altogether,he isn't trying to help you,he is trying to help himself to a commission on every deal you buy from a fsbo,auction.com etc that he had nothing to do with. --72.231.xxx.xxx

Signing that form provides no benefit to you,toss it in the round file. Sometimes brokers push their realtors to get those forms signed, I wouldn't even respond to it unless the realtor followed up on it. --72.95.xxx.xx

When I buy on the mls and an agent asks me to do this, I sign it specifically for the house in question ONLY.

Indeed. I do a "Buyer's Agent" agreement so that the Realtor works for me, not the seller. But it is also specifically only for houses that I ask HIM about or that he brings directly to me. It is clear that anything outside of that does not fall under the agreement.

So, I'm not opposed to such agreements -- in fact, I encourage them -- but make sure it is worded properly for anything that you do WITHOUT his assistance or input.

As a Realtor I wouldn't sign that agreement. You do need an amendment specifying the conditions for which they will be compensated. And, yes their BIC requires them to use a standard form but based on your relationship you are not a standard client and the agreement should reflect that.

To John's point most people do not realize that without a signed buyer's agent agreement the BA is a sub-agent of the seller.

As for buyer's agent agreements in general BA's are fools if they show a buyer a property without one.

NE: A Realtor will only show a FSBO property if they have an agreement with the FSBO that they pay their negotiated commission. --71.75.xx.xx
