State Specific Question About: CALIFORNIA (CA)

We took over the management in year of 2016. All one bed and one bath apartment units. (No rent control)

A single mom with two kids of 15 & 12 year old listed on the rental agreement. Recently, on-site manager found out she has a 9 year old and a 3 month old baby. Manager said she saw a guy sometimes, but he doesn't live in the unit. Tenant also has a comfort animal (Chihuanua Dachsund) that barks a lots. We gave warning notices.

Would this consider over the occupancy limit for one bedroom apartment? She told new tenants how to get doctor's letter in order to keep a pet.

Can I server them a 60 day notices to move out?

I also have one unit has occupants of 2 adults and 2 young kids. The wife is pregnant with twins. When can I ask them to move out? Is it until the new born twins turn one year old?

Keep to your schedule, not their birthing schedule. Besides if you're looking for a friendly time to evict them then they're going to hold a grudge no matter when.

If you're really concerned about it, just don't renew their lease or anyone else she talks to about ESA. --108.69.xxx.xxx

I follow HUD on newborn - exempt for 12 months however I think 2 in a sleeping room and aunt Sally on the sofa is a policy your fire dept will enforce. --76.188.xxx.xx
