My tenant signed a one-year lease but just a few days later claimed she had suddenly found "the perfect house to buy." She wants to know what her options are. The lease allows sublease with written ok from me, and I cannot disallow it if the sub-tenant meets my criteria. But I am uncomfortable with this tenant/her agent being in charge of subletting since neither -- unlike my agent -- represent my interests. (BTW, both agents belong to the same company.) If this tenant subleases, she is liable for rent being paid and her sub fulfilling all other the conditions of the lease for the full year. I am considering offering her the option of breaking or nullifying the lease provided my agent is the one in charge of finding a new tenant. This option means the current tenant additionally would have to pay any commission my agent might demand. But she would no longer have the burden of this house on her shoulders for a full year. Since your lease allows it I donít see how you are going to keep her from it. It sounds like you have veto power over any prospective tenant she brings and given that she is still responsible it doesnít seem like youíre risking much.
Consider removing the right to sublease and adding a lease-buy our or early termination of 2-2.5 mos rent. That puts you in charge instead of the departing tenant. --70.182.xx.xx

Oh boy. Lot's of spoons in the pot. I would offer that she pay one months rent, forfit deposit and walk away! Like an early termination fee. I would want to part in what is suggested as there are to many ways it can fail and holding a string of people accountable is way to difficult. Cut and dry. Let her go. I agree, the more I think about it the more I dislike the sublease option and hope she will see it that way, too. And I think sublease item will go in next lease, assuming DC law permits it. --88.117.xxx.xxx

Aiyee....get that subleasing clause REMOVED from all future leases, unless the laws in your area require it.
Offer her a buyout option. I charge 6 weeks of rent. They get their deposit back as normal, less any damages or cleaning. I "sell" this option to them as an advantage:
"Think about this Ms. Smith: you don't have to worry about a sub-leasee getting angry and punching holes in the wall that you'd be responsible for. AND we don't keep your deposit either: full refund as long as the premises are returned in the same condition as received, except normal wear and tear. We've had problems with sub-leasees in the past violating their lease, committing crimes, not paying rent, or throwing wild parties and that all comes back on the main tenant, which is you.
Would you sleep better at night knowing you won't have to worry about anyone causing you problems that neither of us can control?"

I sell it as an early lease release fee. You pay my fee, which covers my costs, and you walk away. Make sure the fee is enough to cover a month's rent and the cost to find a new tenant with the agent you use.

Did she move in at all? If not, just keep the deposit and first month and let her out of lease. There won't be any cleanup or damage if she never moved in. If she did move in, just get an early release fee if she moves out next month, plenty of time to get a tenant you want.

We ALL know how difficult it is to find a qualified tenant. You don't want a sublessee, so simply hand the tenant a list of qualifications you require from a Sublessee (as there is more risk involved): 750+ FICO, no smokers, no pets, income 4x the rent, etc. After pulling her hair out trying to find somebody to fit your requirements, she's likely to concede and offer a buy out.
Simply put "find a tenant to meet these requirements or you may pay a one time ELT fee in the amount of two month's rent"
I would THINK it would be kosher to have one set of qualifications for a sublessee versus a standard lessee, but I'm no lawyer. --170.224.xx.x
