Help ! I have a sf condo in palm springs which I have rented to a person since 2010. In February his check was returned and he told me the irs froze his bank acct . He went to an attorney which is costing thousands of dollars for him to unfreeze the acct and work out a plan with the irs.
SInce that conversation he has not returned my call or texts. I sent him a letter (1st class mail) to call me asap. No response . I am thinking of calling him at work but they wiould only take a message.
I live in NY state and realize I am over my head . I can only think this attorney told him not to speak to me at all . This makes no sense to me . Does anyone have any theories on this severed communication ? I will have to contact an agency in Palm Springs area specializing in evictions . Any advise appreciated . Thanks BOB --98.118.xxx.xx |

I have definitely heard of and know people who have had the IRS freeze their accounts. Social security can do this as well. So he may not be lying but it seems odd that he'd be ignoring you. He should be able to offer some proof.
This happened to someone who received some benefits due to her father's death they needed to "investigate". While that was being done they froze her account with all the money in it. It was grossly unfair and inconvenient but the bank has to follow their order. --173.170.xxx.xxx |

I once had an elderly couple who were living on SSI. The IRS didn't freeze their bank accounts--- but they started garnishing their SSI checks for some "tax stuff that didn't get paid years ago." They packed up, cleaned everything, and were gone within a few days.
Good tenants-- whether with IRS issues or not-- will communicate and will keep their personal issues from affecting you as much as possible.
Bad tenants-- whether with IRS issues or not-- will fall off the planet and not communicate. Especially if that was February, and we're now within shouting distance of May. He's had his three months to get his game together and figure out a plan... and taking care of you is not a priority.

Chances are, he has moved out already. Maybe have your local contact run by there and see if the place is occupied? If so, evict. I would take the 8 year good tenant thing into account only if communication were still present. Since it's not (and it sounds like you have bent over backwards to try and communicate), I would proceed with eviction. The PoQ notice is called a "Phone call generator" in my house. If he gave you a SD, did you put it in escrow.? Here my name and the tenants would be on the escrow account. If the IRS seized his accounts then they would freeze the escrow too and the bank would be able to tell me that. Either way, eviction time. --71.10.xxx.xxx |
