I rented a room to a person who after 6 weeks became verbally abusive..called me names, screamed at son and when I went to another section in the house at midnight, she called police.They came and she filed report while I unknowingly sat in my room. I was so upset with her I gave her a 3 day notice. I am now being sued because I gave her an illegal notice since it should have been a 7 day. She kept keys to locks and only gave half back. I did give her the sec. back on the spot when she left, but not 5 days of rent which she had coming if she stayed. I also cleaned room and bath no charge also. I used form 3 day for nuisance. --67.160.xxx.xxx

Woah. The police were in your house while you were at home, and you had no idea? It must be very well-insulated. :)

If you're living in a house, with someone, and someone else owns the house, and you're both paying rent to that other person, then you guys are roommates. If you're living in the house, with someone, and you own the house, and the other person pays rent to you, they're you're boarder.

So there are different rules in place for a boarder, like Barb said, than there are for tenants. And in most places, owner-occupants-- whether in the same home, or someone who's renting out the other half a duplex-- have different protections under the law, rather than a person who's renting out a house that they do not personally occupy.

But you're in California. So definitely get some state-specific advice, and some city-specific advice, as to what's correct in your area regarding boarders.

You say you're being sued? As in, papers have actually been filed? Or are these verbal threats about "I'm gonna"?

Oh my, I am so sorry to hear about this issue. If you can afford it, you should hire an attorney. If you're in Northern California, Todd Rothbard in San Jose is reasonable and very good.

I've been seeing so many listings for room rentals in San Francisco Bay Area homes, and I am always concerned about issues like the one that you just mentioned. I wonder if Jeffrey who runs this site has had or will have a seminar at his annual conference or something else.

room inside my home which I own. I am a senior and she was yelling making me feel ill. House well insulated no idea police came did not inform me.She called me names..have other unit rentals elsewhere and said I did this to everyone. Not true. Are you in the San Francisco Bay Area or even in Monterey County?

If it helps, I've contacted Attorney Todd Rothbard's office and received free email help as I was preparing to get some tenants out. You might at least think about calling his office or sending an email to find out how to start getting rid of the person. How scary. Was going to rent my upstairs which had a separate bath, no kitchen back in 1990. Got a call from a woman about another unit that had been filled. She had gone to the same college as I did and was in a decent sorority so I told her about my upstairs. When she came to look she saw my little Shih Tzu dog and said she hated dogs and gave her such a look I knew my little dog would end up gone or dead. So I directed her to a basement apartment I had not yet advertised and she took it. She was desperate because her current room was in a house where the son had a drug problem She was an awful tenant. I had to take her to court. I really don't recommend this way to make money. It's just not safe for anyone in your home. --69.141.xxx.xxx

in most state this is a landlord tenant issue and you have to follow LL tenant law. It's their home. I say most because we all know from others here that CA does some weird things. You may be able to get a retraining order if there's been abuse. I would look at the law for elder abuse not regular. May be faster for elderly. If you think your daughters testimony is relivent Iwould have her as witness. --99.103.xxx.xxx
