The tenant has left the building, the apartment was cleared of all her items but we noticed that the toilet was cracked, globs nail polish on the floor, gum on floor and walls, oven not clean, all blinds damaged, window cracked, walls, doors, carpet dirty and bed room door damaged.

Can we charge for these items?

Yes. The security deposit is used to pay for damages beyond normal wear and tear. Per my lease:

"TENANT agrees that DIRT, FILTH, GREASE, GRIME, SMUDGES, DINGS, HOLES, STAINS, SCRATCHES, TEARS, CRACKS, CHIPS, AND BREAKAGE does not constitute normal usage and will be billed as damages"

Your state laws may be different and limit what you can charge. Generally, if they break it or leave it dirty, they pay. --173.17.xx.xx

yes you can-- did you compare your MOVE IN INSPECTION against the MOVE OUT INSPECTION you did with them.

Make a list with estimate of cost and mail to Xtenant. I have no idea what the laws in your state are concerning inspections-documentation or date of return of deposit so you would be wise to check your laws.

I would charge for all of those EXCEPT that I'd have to give thought to the cracked toilet and cracked window. For those, I would say "it depends." There are situations where I would consider a cracked toilet to be damage on their part -- and there are situations where I would consider a cracked toilet to be a fixture that broke over time and I'd cover it. Depends on the situation.

That being said, when they don't TELL me anything about it and I find out about it only a move-out, then I tend to go with the "this was probably their fault" side of things. :)

If not please look those up or perhaps someone from your state can give you the nuts and bolts to get you started. So, I haven't been to the Convention yet (but hope to do so soon -- but it won't be this year)... But do they really teach the "nuts and bolts" stuff there? I guess I assumed that "how to handle a security deposit return" would NOT be a topic really covered at a convention like this.

The convention information says it is trying to focus on "wealth building and landlording strategies which allow you to make more money (with less effort) from real estate activities and your rental properties."

I guess I'm just curious about who it is really aimed at and would be best for. I've always assumed that it was for more experienced LLs (like are often found on this forum) that are trying to do things even better. I guess I never thought of it is a "nut and bolts" thing where a LL like the poster here would learn how to do normal deposit returns/handling.

Is that not the case?

John, that's what I thought when I went for the first time last year. I would say maybe Mr Landlord's Biit Camp for new landlords; I haven't attended that.

My local Apartment Association offers an excellent one day landlord, taught by a successful RE attorney. A local group is the best place to start, in my opinion, as that attorney knows the local judges, and how they interpret the laws.

Anita, in my area, one has to be careful to separate out 'normal wear and tear' from damages, and it can be very, very costly if it were to go to court and the landlord has it wrong. My suggestion would be to search for local landlord/ apartment associations. ( Ours is called apartment association, but many landlords in the group just have single family homes, both single and multi-family properties are discussed.) --172.58.xxx.xxx
