State Specific Question About: CALIFORNIA (CA)

A young couple moved in on 4/6/2018. They didn't turn on the utility till 4/11/2018. The gas company said there was a leak outside of the unit, so no gas till the pipe was repaired. The couple got very angry. Manager said we will try our best to fix the pipe ASAP. The wife said we are not going to pay next month rent because there are something else in the unit are not in good condition. Manager said they didn't mention anything on the move in check list. Anyway, I told manager to ask for the list.

On 4/11/2018 afternoon, the male tenant hide by the laundry room and jump out to yell at the manager again. He said, " Are you trying to avoiding me? Why I don't see any one start to do the repair?" He said he wanted to move out. He wanted the full refund of rent and security deposit. I told the manager okay, if they will return keys by tomorrow.

On 4/11/2018 evening, the wife wrote a long letter said she refused to accept the offer, and she will stay. She said she is 9 weeks pregnant. The list of things that they complaint about like 1) Bathroom towel holder rail was not installed correctly. (??) 2) Shower head is not sealed on the he wall. (??) 3) Crack line on the wall. 4) Missing cutting board. (already stated on the lease, no cutting board is provided) 5) Broken tile by the edge of living room. (tenant meant 4 pieces of tiles were cut to fit the edge were not 16 " x 16" whole piece. OMG) When the male tenant delivered this letter to manager, he was yelling at the manager again.

On 4/12/2018 morning, the male tenant came at 7 am to tell manager that he wanted to move out, and he wanted the money today. He would called around 9 am to return keys. I prepared the paper and money to wait with the manager because the manager was kind of scare about this male tenant. Manager called the male tenant several times, but he never returned calls. So, manager called the wife, and the wife was talking very nicely and apologized about the argument. She told manager to communicate with her from now on. She said she never agreed to move out.

We fixed and restored the gas on 4/14/2018.

We scheduled a repairs on 4/17/2018 for this unit. In the evening, the male tenant came to ask the manager, " Did you really get the permission from my wife to go in to do the repairs today?" Manager said yes, and he walked away looking worried.

On 4/18/2018, the neighbor tenant reported to manager that she heard the new tenants were fighting last night. Manager told her to call the police, if it happened again.

4/19/2018 Manager filed a police report because this new male tenant was skate boarding early in the morning around 4 am and 5 am back and forth in front of manager unit.

We signed a 6 month lease term. I want to end the lease as soon as the lease expired on 9/30/2018. Do I send a letter on 9/1/2018 stating that we do not wish to continue the lease? Or, an official 30 day notice? The female tenant is pregnant, would that be a problem?

The manager doesn't feel safe to have this new male tenant around the property. Do we really have to wait till something happened in order to ask them to move out?

We checked through all their credit and previous manager, and they provided all documents as requested. Manager said they looked normal and talked nicely when they came to apply the unit. Who knows the male tenant is a very emotional person. The couple is weird.

Lack of prompt repairs CAN be a good reason for withholding rent or demanding a reduction.

Do I send a letter on 9/1/2018 stating that we do not wish to continue the lease? " You can send any letter that you want, but it has no legal validity. You agreed to the lease, you have to keep your bargain. A 30 day notice also will have no legal effect, since the tenants have a lease.

Pregnancy has nothing to do with this matter.

If the manager REALLY ISN'T SAFE, then go to court and ask for a restraining order. If the judge doesn't think much of youir reasons, then he will not grant the restraining order and he will order YOU to pay the young couple's lawyer fees and court costs.

My suggestion is to get along, wait for the end of the lease, and then get new tenants. In this regard, you didn't say if you are under rent control or what your local rent control law says.

Don't be intimadated. Don't let your manager deal with this alone either. your plan is we have a contract. The line repaiir is being done at first availalbe date. Any other items - unless life threatening needs to be submited so we can include it on your move in sheet.

Should you not pay rent when due we will file at first available date for nonpay with court. You are hereby notified it will become perminant part of you rental history for other landlords to see.

Lastly you are not permitted to act in a hostile why to any of the employees who are here to help you. Then ignor them. They are Pis&&& off type people and your fueling their rage. Don't give in to them.

Call police and get case numbers and get it on the record. Remember the less you fuel them the better. --99.103.xxx.xxx

I had a tenant who was pregnant during the Summer when she moved in, and I do feel that pregnancy can cause some women to act oddly. An already nutty co-worker told me that she was insane and overly emotional when she was pregnant and would nitpick over everything having to do with her house or her nest.

It sounds to me like you have a very short-tempered, controlling man who is very possibly committing (or will soon) domestic violence. This is BAD! Do everything you can to move them out ASAP. Hopefully, your rental agreement has a clause about obeying laws and living peaceably with neighbors that you can cite in eviction court.

Bad. Bad. Someone gave them keys without checking with utility company for service. First mistake. Who is their emergency contact? Call for some backstory? Mental health issues? Call their previous landlord for the real story. Background check? More screening is needed or your get more of same.

Installing cameras for sure and continue to log the dates of communication . perhaps a call to the police's non emergency number For some advice or can they drive by more often? Do what you can.
