Friends of mine used to be involved in the training of service dogs. One of their pets was a service dog that didn't make the cut. But it wasn't just something they did in their spare time for a friend-- they were under the auspices of a structured organization.
Not all dogs that enter the training program are allowed to graduate. So I'd be very skeptical of anyone who assumes any dog will end up a full-fledged service dog... because many fail at some point in the process. --96.46.xxx.xx |

Two tenants of the same apartment complex made claims that they are doing/working with dogs, training them for "special needs children". That's why the dogs are in their apartment.
One was telling the truth. They work with Cesar Millan who has a location a few blocks away. Each time when I go to the property I see my tenants vehicle in the employee parking lot of that property.
The second tenant, who make claims they were helping train dogs for "special need children" was telling the half truth. They them self train dogs and then sell them for profit, using my apartment as a boarding house/kennel. They have no insurance or a license for this kind of activity. That's IF this prospect is a certified trainer. I can tell any of the Landlords on this discussion board that I have a 2 year old German Shepherd that I am training to be a service dog. HOWEVER, What credentials do I have to train the dog. AKC trainer???
NE I would check out his present living conditions. IF you plan to rent to him. What does the yard look like? What's the condition of the house? A German Shepherd is a HIGH ENERGY DOG that needs space, a yard. If your property has a very small to ZERO yard its NOT a good fit for the dog. Did he bring the dog with him when he was checking out your unit? How well behaved is the dog? German Shepherds are great dogs HOWEVER they need to be trained properly. --99.56.xx.xx |

This will help you sort out the problem dog owners --> You will hear a lot of these terms with pets so listen carefully to what the applicant is saying and take notes – I get my pencil and paper ready before I ask -tell me about any pets-, my insurance needs photo vet records
Emotional Support Animal: No special training required but they do have to conform to certain behaviors such as potty-trained and non-aggressive. They are often prescribed for PTSD sufferers and there are several good training facilities that expand on these services to teach the animals when a panic attack might be coming on. Canines for Independence is one organization that works on this, and there are veteran orgs too, but in reality any ol' dog, cat or pony qualifies if they comfort the owner and allow them carry on everyday life. Requires a prescription from a health care professional but no special training and no, you can't charge extra.
Service Dog: highly trained animals that perfect specific services for their disabled owners. Seeing Eye dogs, Diabetic Alert Dogs, Hearing dogs, etc. THERE IS NO REGISTRY FOR THESE DOGS, so when someone says, "I have a registered service dog" they are lying. Unless they mean registered with the county for dog tags. I would so welcome a real service dog, they are admirable animals doing great work. No extra fees allowed. They can go anywhere, they are not pets, they are medically necessary.
Therapy Dog: goes to hospitals, trauma centers, and other areas where trauma has occurred. They are not specially trained, they are just nice friendly huggable dogs (often golden retrievers or Labradors) and are considered a PET by the law and the landlord. While those definitions are correct, this case is still a little different. Like razorback_tim said -- even if this IS going to be a legit Service Animal at some point, it doesn't matter. Animals being trained -- or even real Service Animals that are not with the disabled person -- do not fall under the FHAA.
I mean, you could have a legit seeing-eye Service Dog that is fully trained to lead the blind -- if it is still with the TRAINER, then it does not fall under the FHAA. Even if it is a REAL trainer.
The law covers a disabled person and their Service Animal. It does not cover a Service Animal in training or even a trained Service Animal without the disabled person.

In a situation like this, with a trainer, I would assume that this trainer would have to be certified. The authority that the dog is being trained for should be licensed or certified in some fashion and provable. And there would also be a deadline as to when the Dog would finish being trained and out of the property. Would that be correct? Also does that open the door for this trainer to have revolving door service dogs in and out of the property? I'm most likely going to send her west for some other reason, I'm just wondering about the reasonable accommodations for her being a trainer. This is a little interesting. --174.201.xx.xxx |

IF IF IF this is a legit service dog trainer I would have very little worries about allowing the animal since these folks would have to be highly disciplined. I have had several applicants lately state they were training a ESA, which as far as I can gather there are no training requirements. Those folks had other issues that kept them from qualifying so I didn’t have to address it. LotF: ADA wouldn't apply anyhow. ADA doesn't generally apply to use as residential landlords. The FHAA does.
I think he's fine to disallow on the FHAA -- but, as mentioned above, his STATE has laws specific to Service Animal TRAINERS, so he has to follow that.
I'm not sure anyone here can really answer that unless we happen to have a PA expert that has dealt with it.
