Someone voted them into office.

Remember this on election day.

Why add them to the lease? Because not all cases go to court and people will pay them.

MY judge will not allow them unless late fees are written into the lease.

Are late fees unenforceable in CA? Seems like several of our CA posters have indicated they have late fees. Double check yourself.

Why are things in leases even if unenforceable? Because he who fails to ask fails to receive 100% of the time. If your tenants don't know that late fees aren't enforceable in a court, but they pay them anyway, you win. If they don't pay them...meh. Simply non-renew their lease.

It is not true that late fees are "unenforceable" in CA. What IS true is that the Appellate Court has found that, according to the law, only actual expenses may be charged and that for the most part, landlord does not have very many actual expenses as a result of a late payment.

Late fees are enforceable, but the amount that a landlord can collect is usually not worth his effort.

Its true that Landlord has virtually NO expenses due to rent being late by a few days. What stops a tenant from being chronically late is that other wise landlords won't take him and thus he has difficulty finding housing.

Here in California we have changed the way a landlord can charge tenants for late fee's. For example you can't charge someone the same amount for being late only one day and charge another tenant who was 5 days late the same amount. Also there is a limit on how much you can charge in a late fee.

For example if rent isn't received by the 5th of the month, then on the sixth of the month a $25 administration late fee is due AND $5 for each additional day until the rent is paid -- (Up to 6% of the tenants rent).

True on a 3 day notice you can't ask for late fee's, but you can, with written notice, deduct late fee's from the tenants security deposit. --47.156.xx.xx

Robert CA I see that. Our state or local court wants reasonable fees. I mean yo can't keep charging 10 a day for ever.

our lease is simple in that we get $8.00 a day from the second day to day 10. $80.00. After that it converts to just 10% of rent owed.

So if they pay on the 7th-- they pay $56.00. But here's the catch-- if they only pay half the rent lets say 500.00 they pay the $56.00 in late and now 10% on the balance ($500.00) or $50.00 more. Hope that makes sense? --99.103.xxx.xxx

In my rental agreements I have "6% of the rent" as a late fee, and I also give the tenants up to 5 days to have the rent in my PO Box. Some tenants go directly to my Post Office to make sure rent is in on time. So for the average rent of $2,500 the late fee is $150.

It works. Mutual respect works. I'm an easy going LL, but very tough on enforcing the details in the rental agreement. Since 1976 I have had only 3 evictions involving the sheriff. Blind luck? I don't think so. --99.59.x.xxx
