Never had to take anyone all the way to court before.

And never had anyone take me to court before.

But I am now - both! Should be a great learning experience.

I have file against the former tenant of the house I just sold, for unpaid damages when she moved out.

Today I got a notice that my just-moved-out roomer got one against me. She has absolutely no grounds for anything(already double-checked with my attorney). She stated on the warrant that she was made to move because she made a report to the city. That's the first time I had any idea (confirmation) it was her!

I will lose two days of work from my paycheck job, but I'm sure will be well worth it. I wonder if I can get paid for that? Hmm...

Don't want to muddy the waters.

you or the city.

In my area a city will condemn a property which means the tenant has to move. If this didnt happen ask to see the letter from whomever made her move.

moby: There is no damage, and I am sending security accounting and refund tomorrow. If she doesn't have a forwarding order (I doubt it), I'll have it back & take it to court with me - unopened.

Mike: I gave her notice of non-renewal with no reason given other than it's my right to not renew at the end of the term. Property is not condemned. It was a couple stupid insignificant things that were reported - anonymously. --68.10.xxx.xxx

DJ, most likely the tenant that you're suing won't even show up in court. Regardless, after the judgment is awarded, our fine Commonwealth makes it incredibly easy to garnish their pay. Just make sure your records are up to date with their employment information. --170.224.xx.x

DJ i'm sorry I don't get the situation. She had a room? you sold the house? she did damages? Former tenant?

You sued for damages and X tenant counter sued? on your original suit?

Whether you think this person will show or not now that there is a counter suit--- bring your attorney. Attorney fees for winning party can be billed (as long as you have that in your lease)

MYOB: If memory serves, someone, identity unknown, made a frivolous complaint to the City inspectors. LL had no idea who made the complaints.

Completely independent of the anonymous complaints, the LL decided not to renew a tenant's lease. This was not retaliatory -- could not have been because LL did not know who had complained.

Now, T seems to have filed a "warrant" against the LL.

[I do not know VA civil procedure, and do not know what a warrant is in this context.]

Sounds like she is going to try for damages for hardship. Who knows? I told you that you were better off not knowing who it was. I don't see where you have broken any law. Have you rented the room? Perhaps you can say you felt threatened by the tenants behavior, or that you'd gotten anonymous reports from other tenants that were uncomfortable by her demeanor so you were trying to keep peace there. I wouldn't think the courts would want to be tied up with truly nuisance litigation. Good luck, can't wait to hear how this turns out. --71.51.xxx.xxx

Yes, Mike's memory is good. And the other one is a different former tenant in a different SFH who didn't pay for damages - and I'm suing that one.

Jason - good to know garnishment is easy here. I've never done it before. I look forward to a great education during the next few weeks. --68.10.xxx.xxx
