Howdy,

As I drove by my property today, I don't see a sign of the tenants are moving out.

Actually, Texas gives a week(seven days) , e.g. Judgement on Monday, then moving out deadline is on Monday by 5pm, if the tenants do not file the appeal to the county court.

Did any of you go thru the Wit of possessions and the constable comes and remove the tenants belongings to the curb? Any thing I need to know about this process.

The issue is the tenant will have another two free weeks to stay in the property until the constable come to the door.

What kind of legal loopholes in the legal system? They knew how to play the game. Unluckily, I only heard from last landlord that the same tenant did not pay one month and ten days rent, the eviction was filed, but the tenant moved out on the day of the hearing, so the eviction had to dismiss, but they still owed one month and ten days rent.

Now, they owe me four months rent. And they said they are moving to another state, so they can play the same game again to get the free rent.

Can any legal/law to prevent this type person repeating their behavior.

4 months without payment? did you file ASAP or were you the nice LL?

If you supply the manpower you need to know how many bodies you need to keep the sheriff happy and to get it done quickly. 4 men.

Here we file for the writ of possession. That writ is signed by the judge and the sheriff comes to collect them and it takes about 5 days to get into the system. We call the sheriffs civil division to see if it's been received-- once they acknowledge receipt we ask for a set out date. Occasionally we call to try to move it up-- i case there was a cancelation by someone else.

I get a writ on every one after I made the mistake once, it only cost 15bux in my area and it ensures that you get your place back, go back to the clerk, get the writ and finish the job the court started. --76.188.xxx.xx

The cost of an eviction in Texas:

the application fee for two tenants is $200.

the writ of possessions is $170.

it does not including all my time, the attorney consultation fee...etc.

Does a vendor specialize to move stuff to the cube that I can hire?

What do I do after the staff in the cube?

The truth is I am very afraid of this hostile tenants, and very concern my own safety.

Alice TX those fees are a smal price to pay when up against 4 monthsof no rent and more months coming.

You at this point should not need a consult fee-- haven't you doen dispos before?

Curb? and safety. Get 4 big people-- contractors family friends whom ever bring contractor trash bags and move um out.

Safety-- sheriff will be present. Request he do his duty and remove resident to curb-- don't let them wonder about while you do the set out. Second put up notice of "no trespass" and ask the sheriff to remind deadbeat not to enter the premisesor they will be arrested for trespass.

CARRY a gun.

Right after set out nail all door shut (except your front door- change the lock--- leave so there is no confrontation with dispo person. check back later in day.

I did have one tenant who kicked in th eside door and mover her stuff back in. She was arrested. --99.103.xxx.xxx

A thorough credit on all adult applicants heads them up at the pass where they are in the eviction merry go round which is a never ending story. They may not move out of the area but stay in the same town or city. If there is a judgement then you have find a means to collect. Most of them completely trash out the rental unit as well so be prepared for major clean up. Had a person come around who was holed at mothers basement around 30 years old with his girl friend where he said his girl friend would not fill out a rental application form for a credit check. They called back around six months later where they are going to be holed up in mothers basement for a very long time. Prevention is worth the cost of a thorough credit check on all adult applicants. Sometimes only out of the cost of a few photo copies instead of rent arrears, legal costs along with damages, cleaning costs. In province of Ontario it can take six months to evict when they play the system so they can rent free for entire year with two rental housing providers. --147.194.xxx.xxx
