State Specific Question About: CALIFORNIA (CA)

We own a fourflex rental and hired a property manager who issued a 60day rate increase on Feb 1,2018 effective April 1,2018. Before April 1, 2018 he quit, is the 60day Notice still effective? Tenant did not pay the rate increase stated in the

Yes IF you are sure he sent out the notice. Maybe he failed to send out the notice of increase and decided to quit rather than be fired???? Only 30 days is required if the increase was 10% or less. --75.22.xx.x

If the notices were actually served on February 1, then an April 1 increase gave only 58 days notice: not enough if some tenants have been there for more than a year. If he sent the notices by mail, then 5 extra days are added before the service is complete.

You're right, Jim. I only do 1-year leases, so I have never been involved in rent increases.

But February 1 is still not enough for 60 days notice. Even from the date that service is complete, notice period starts on the next day (February 2), and don't forget how many days are in the month. And notice by mail allows 5 extra days before service is complete, making the notice period 53 days.

February 1st is not enough notice ONLY if your tenants are wise to the fact that you have to give them 60 days.

The risk is, that if the tenant doesn't want to leave or pay and you try to evict while tenant gets an attorney (public or otherwise), you will lose the eviction for failure to observe the required notice period.

The moral of the story is, that landlords need to be wise about what a 60 day notice requirement really means.

I didn't say evict. I said let them be the ones to bring up the requirement of the 60 days notice.

Roll with it as if they got the notice. Add the difference to next month's bill. If they pay, you're golden. If they say, "Hey, you didn't give me 60 days notice!", then by all means have a new one taped to the door by the end of that day. Start over.

If they don't pay your increase or rent at all, file for eviction for non payment and let the judge sort it out. --174.201.xx.x

Coleen,Cead Milea Failte.You should be glad he quit,for a four unit, you don't need anyone to manage.Doesn't leave enough room for profit.You have come this far on your own,so you don't need to throw it away now.I would still assume he sent the notice,so expect it to kick in,in May's rent.If not its up to you,, what you want to do,talk to them or evict,if they're good paying tenants,comprises.........charlie.....................................................

I own a bunch of single family homes that I purchased years ago. They cost me a song. But over the last dozen years, when a home became vacant I did a complete remodel.

So when I re-rented those homes out, I was critical to whom I rented (they had to have stellar credit, good income and limited number of occupants/pets).

So I did an experiment on "Rent Rises". After the homes were remodeled I was able to get "Top Dollar" and quality tenants. I did NOT need to raise the rent which may cause a tenant to leave. Instead of house hopping, since the rents were kept the same, tenant had little reason to leave.

a) One home a tenant (single mom) moved into with 4 of her children. One got married and moved out. Another child graduated college and moved also. So now it's only the mom and two kids in a 5 bedroom home. But since here rent was manageable, she stayed even though half of her children moved out and her child support was cut in half. Shes going on 7 years.

b) This house was rented to a couple with 1 child. They stayed 4-1/2 years than moved after buying a home. I did not raise their rent either. The replacement tenant got a $100 a month raise, they are going on their 4th year.

c) This house was rented to teachers with two kids. Both children moved out and the couple was happy with their rent. The time and cost to move served no purpose because they liked having 5 bedroom and 3 bathroom -- a place for out of town guests to stay. After 6 years they finally moved and downsized. They moved to a new townhouse complex and pay about the same rent for only two bedrooms.

When I work with good tenant fixing things an needed, within 24 hours and keep their rents the same, they in turn take care of the house and stay there LONG TERM, from 4 to 10 years... --47.156.xx.xx
