OK I have a court order that tenant must be out by end of month,..however he seems to be taking his sweet time The court gave him additional 6 months to move. Thats a long story in itself,

The rest of the tenants say he is still there, moves out a small car load every once in a while. Has been there a long time and has a lot of stuff,..big apartment, 2600sqare

I have quite a few people clawing to get this unit and 2 look like ideal people. I hate to lose them but their circumstances are they need a place soon.

Anyway,..I understand I may have to pay a sheriff and pay a mover and pay to put his stuff in storage. (I'm guessing he will leave mostly junk, but a fair amount of it.) So how long would I have to store it before its considered abandoned,..would he have to pay the storage fees to get his stuff back if he wanted it?

Is there anything I should be doing now?

Don't assume we/good lawyer didn't try t get him out. He feigns that he is a disabled war vet,...well he is disabled but got injured in a car accident after he left service and got drunk and lost a leg and most of a hand.

The judge felt because he was a disabled veteran that he should be given more time to find a suitable place for his family.

The guy has anger issues and a good long term tenant said she heard him threaten a neighbor that he has problems with an assault rifle. he was a demolition person in the army. Has blown up things (as far as I know just In fields and gravel pits etc) but I don't trust him,..has been there a long time but is getting weirder and more unstable as years go by.

I wonder how much lead to line up the sheriff,movers, storage area.

Side note , I will have my by far best handyman and his helper for the first few weeks of April only,..to do painting and other things that will probably have to be done. I would like to get this done as soon as possible,..

Are you saying that his court agreed 6 month grace period is coming to an end at the end of March?

The Marshall/sheriff/city officer should give you a date/time when they are coming. Don't expect them to be punctual, but they do finally arrive. They will do the eviction, ask you to change locks...sign some papers and leave.

In CA you can remove all personal possessions left behind into storage, and the tenant has to get them from you. If he really wants them, you can extract money he owes you as leverage. After 30 days they become abandoned. The costs of moving, storage and disposal could be taken out of the SD - if there is anything left there. Otherwise they become a tax deduction for you. --99.59.x.xxx

I guess with a missing leg and part of a hand it's going to take awhile. I would find a mover then ask the tenant if you can pay for the move then do it before you lose your applicants. But you must know it's not going to be ready to move in condition. Now the threatening behavior with the rifle should be the key that allows some agency to just come and get him and lock him up for awhile. This is what should have been done to the crazy who shot 17 people at the FL high school. If they say they are going to do something, believe it and lock em up. --69.141.xxx.xxx

No you can't. He owes the money and you can try to collect in, but in the end you have to give him his stuff, whether he pays or not.

I've had an eviction once, the sheriff got the tenants out, in their underwear, had me change locks and sign papers and said adios.

The tenants asked: can we go inside and get dressed?

Sheriff: No

Tenants: what about our stuff?

Sheriff: Negotiate with LL, pay him what you owe, get your junk.

The sheriff left, tenants were started walking away...in their underwear.

I stayed in my car for awhile, to see if tenants would return...they didn't. Later that day I removed all their junk into the garage. On the 30th day the Salvation Army picked it up. --99.59.x.xxx

6 months! Yikes!

So much of this depends on your local office. I suggest you call the sheriff dept and talk to the actual person who does these lock outs. They are usually happy to orient the LL because it makes their job go smoother and helps keep the peace. Most have a heart to serve the public and a duty to explain the procedures.

What part of MA is the unit located in?

Google Jim Appleyard & EvictionMovers.com ,they are in Eastern MA. We've had them speak at out LL Group. I'm sure if you call them they would have a reference for you area if they don't service it.

They can arrange for the moveout notices, the constable, the packers / movers, the actual moving, the storage and the disposal of ant items declared trash.

Wow Michelle of MA, Thats amazing six months extension by the judge.

However, I would call the sheriffs office ask for the person that does the evictions / lockouts. Let them know the concern of this tenant threatening a neighbor and what can they do as the sheriffs dept. I will guess the sheriff dept will tell you they will do nothing because a crime has not been committed. But its worth a try!!!

Contact your local veterans clinic or veterans hospital in the area let them know about this vet. He could have PTSD (if he saw active duty) ask if they can help in anyway with him. The other option and this may seem a stretch but talk to your US House of Representative for your area. Talk to the office manager they may know of a way to help him.
