I haven't had this issue in forever, but it has come up in the past and might come up with the Toxic Tenants' move-out, don't know. So recently I added a $25 per hour charge for tenants who don't return possession by 12 o'clock noon on last day of term (which is already in the lease and has been forever) assuming of course they are not renewing!

Do you address overstay/holding over at end of lease? How? --50.82.xxx.xx

In NC, the lease prevails unless it is against state law. And it is not against state law to state an exact time when possession is to be returned. --50.82.xxx.xx

So do your tenants get a prorated amount for the last day. If your rents are 1500 per month, assuming it’s a 30 day month, do you discount $25 since they don’t get use of the Property the whole day. --198.205.xx.xxx

No. Our leases explicitly say, on page one, "Lease term is from XX/XX/XX at 12 o'clock noon and ends at XX/XX/XX at 12 o'clock noon.

If their move out day is the last day of the month and they are current on rent they have every right to stay that whole day. We charge per diem if they stay past midnight on the last day of the month. --71.75.xx.xx

Hmmm...My first reaction: Sounds like a good idea if you have a new res lined up and waiting, but tough to track and prove an exact time.

If this helps -

My lease is clear: 'The last day of the lease period is designated as NOON local time on the specified day. Any holding over will be billed at $200 per day due to costs and inconvenience incurred by multiple parties – Management, cleaning crew, painting crew, repair crew, marketing costs, the Resident who planned to move in, his/her moving crew and truck rental, etc. To avoid this extra cost, put items into storage, return the keys, and rent a motel room. In the case of tenant not peacefully vacating after management’s final notice, this lease becomes a daily rent lease taking on the same right of a hotel, enabling management to remove any personal property and have the persons arrested for trespassing and/or theft of services.'

My judge wants reasons for fees.
