No I do not make that part of the discussion. It is spelled out in detail in my lease. I just make sure they understand what is allowed and what isn't. They can take it from there.

Most of my tenants are college educated so there is a certain degree of expectation on my part. Unfortunately today that is not a guarantee of reading comprehension or common sense. --71.75.xx.xx

I don't explain my process, but I give scenarios during the lease signing.

I have a waiver of notice to quit in my lease. I explain that this means if we ever have to go to eviction, we don't have to give you notice, we can just go.

I also have a clause regarding tenants default and I give the scenario that if we go to eviction and get a judgement, we will use whatever legal means necessary to collect including wage garnishment and property levy.

Good management keeps me away from most of that stuff most times, thankfully. --50.107.xxx.xxx

I let them know up-front. I have recently amended my pre-written email I send in response to Zillow inquires. I added a paragraph along the lines of "We are often on-site landlords who actively manage the property. Please read the enclosed sample rental agreement, especially the section marked RULES. Please do not rent from us unless you can accept and follow these rules in good faith."

Our tenants are very good about paying rent on time. Our only recent problems were one tenant moved out and "gave" the apartment to her 20 year old son and his friend, and one tenant was babysitting a pitbull. Sorry, that is not going to fly! I have in the past. I tell them McDonald's doesn't feed the homeless and they have a lot more money than I'll ever have and that we no one stays for free. First off right before they move in I give them a piece of paper with all the banking instructions to pay the rent. I use that time to tell them we have a Zero Tolerance policy with stiff late fees so you don't want to pay late.

When someone calls or texts me for the first time that they will be late or maybe be late I tell them them the late fees again and that they will be served a Pay or Quit letter which is the first part of eviction. That seems to work. Most of the times they pay before they are late. I am very open about our practices and what the consequences are. --173.239.xxx.x

Costs too much in attorney fees and turnover costs to evict someone for one or two late payments. Not worth it especially if it means a vacancy in the winter.

Obviously I will have atty file if they ignore me or are more than a month behind. I always collect 1.5 mos SD so I have a cushion for these kinds of things. --12.47.xx.xxx

My lease is clear: (in bold type, I read it to them, and circle) Management does not allow late or partial payments. With a 3 day notice, often by text, resident's rights will be terminated.

The time to educate our expectations is at the start. WHen the rent is late our management is too late - it's playing catch up rather than being preventive.

BTW Recent ZT Stats for March: 1 unpaid, filed. Down from 25 a month.

AllyM of NJ a $25 late fee after five days! The $25 seems a little weak. Change your lease to increase the late fee. Now that being said what is the highest amount in late fees that NJ landlord tenant law permits????

That guy pays weekly. We autodraft his account every Friday.

The account did not have enough to cover the draft so it "bounced". We discovered this on Monday AM.

He promised to deliver a money order Tuesday - he did not. We filed Wed AM. Hearing is in 14 days.

Yes if he pays everything he owes before court he can stay.
