This is my first dealing with an eviction and court.
Last Nov I gave a guy in the navy a Pay or Quit. He quit and got owing me 1900 in rent and another 1100 in damages. Throw in AdLitem fees and court fees and I am at roughly 3200. He hasnt showed up to any of the three previous court cases, and I dont expect him to show to the final one on March 27th.
The AdLitem reported to the court that there is no military duties preventing him from appearing. As a result, I expect to get a judgement in my favor. I will then try to get a garnishment, but was told the Navy often wont honor them.
If I get a judgement, and he files bankruptcy, is there anything I can do to keep my judgement intact?
Looking for advice on how I should proceed after I get a judgement.

To the best of my knowledge, all LL-T judgments are dischargeable in bankruptcy. There is nothing I know of that you can do to protect your judgment.

A LOT of Navy folk bank with Navy Federal Credit Union. Their headquarters is in Merrifeld, VA. If the Navy won't garnishee, it may be worth checking if he's got account there you can seize. --173.17.xx.xx |

I had a problem with a woman who was in the military who just up and left one day. On the advise of my brother who is a retired military officer I did call her commanding officer. He asked me to send him a copy of her lease. Two days later he sent me a letter stating she would be making monthly payments to fulfill her obligation. She ended up making good on the remainder of her lease without my having to go to court for a judgement. --71.75.xx.xx |

If you ask to speak with the commanding officer, you will end up with his Command Master Chief, so you can start with him.
I assure you that he will get a court ordered judgement fulfilled. I have been retired for about 13 now, and when I retired - disbursing had to honor wage garnishments as long as military duty didn't cause the hardship.

You may need a judgement collector. Eviction lawyers know where to find them. They will charge a %, but have higher rate of collecting than the average LL.
Once I evicted a tenant (she didn't pay rent and had a cash job), I got a judgement that wasn't worth the paper it was written on, and was ready to write the loss off.
The following week I got a call from a LL asking about her. This stupid tenant applied somewhere near by, and put me as reference...You can't make this stuff up. --99.59.x.xxx |
